There have been concerns about Costa Mesa police officers parking near the tire shop just down the street, apparently monitoring patrons as they leave Pub 33. Customers have reported being followed by police vehicles and subsequently pulled over for what they believe are questionable or unjustified reasons. Even more concerning are reports that officers immediately begin questioning drivers about alcohol consumption or possible intoxication, despite no apparent evidence of impaired driving. Nobody disputes that police should enforce DUI laws and keep dangerous drivers off the road. However, **there is a significant difference between legitimate DUI enforcement and seemingly targeting individuals simply because they visited a bar or restaurant that serves alcohol.** Customers should be able to enjoy a meal, watch a game, or socialize responsibly without feeling that they are automatically under suspicion the moment they leave. My concern is specifically about repeated interactions with Josh and how management handled my attempt to address the most recent incident. On Friday, October 23, I was talking with Albert, someone from the establishment who has always treated us kindly and respectfully, near the pool tables. Josh approached regarding Albert not taking his turn quickly enough. Albert did not argue over the table. He handed Josh the pool stick and told him to go ahead and take his turn. I genuinely didn't know there was supposedly a time requirement for taking a turn, so I asked Josh about the pool rules. During that exchange, Josh got in my face and told me words to the effect of, "What I fucking say goes. I have the last fucking word here." Because this was not my first uncomfortable interaction with Josh, I asked him why he seemed to have a problem with me and the people I come in with. The argument became heated, and I did yell back. Eventually, however, I turned away from Josh and tried to disengage by speaking directly with the bartender and asking how I could contact the owner. Josh then went behind the bar and continued yelling at me from there. When I questioned him about drinking while working, Josh told me he was NOT working. That left me with a serious question: if Josh wasn't working, why was he behind the bar, enforcing house rules and asserting authority over paying customers? The following morning, I called Rack Um Up and spoke with Dee. She told me she would text the owner and ask her to contact me. I also returned to Rack Um Up on October 24 at approximately 5:25 PM because I wanted to address the situation directly before posting publicly. I spoke with Mike, whom I understood to be management. Mike also told me Josh was NOT working the previous night. When I asked why someone who wasn't working was behind the bar and asserting authority over customers, Mike said he didn't know and that they would have to investigate. I asked whether the surveillance cameras record audio and how long recordings are retained because the footage could help establish exactly what happened. Mike said he did not know. Eventually, Mike told me that I could contact Tustin Police and that he couldn't speak further about the situation. I have also understood both Josh and Albert to perform some type of security function at the establishment, although I do not know their official employment or contractor status. Neither was wearing clothing or identification that identified them to customers as employees or security personnel that night. After this happened, I found a review from approximately six months ago that specifically names Josh and alleges repeated aggressive behavior, going behind the bar, and getting himself drinks. I also found another recent review describing an employee asserting priority over paying customers at the pool tables because he worked there. I cannot personally verify what happened to those reviewers, and I am not claiming that every older complaint is about Josh. I can only say that some of what I read was concerningly similar to what I personally experienced. Again, this is not a criticism of the bartenders or the entire establishment.
