[REPOSTING AFTER THE PROPERTY HAS DELETED OVER TEN TIMES AND HAS MADE NO ATTEMPT TO APOLOGIZE OR RECTIFY THE SITUATION]
*** Due to the hotel relentlessly deleting my posts across platforms and suppressing my questions, I've decided to continue with litigation in District Court. If you've also been affected by this property (through harassment, unsafe conditions, retaliation, illegal lockout, etc.) please reach out to me. ***
I am a former guest of the Newhouse Hotel (owned by Dikeou Realty LLC). I am sharing this detailed, fact-based account to warn future tenants. All events are documented with police reports and a court filing.
On February 1, 2026, I was cornered and subjected to prolonged racist harassment (called racial slurs, including the N-word, "Your kind isn't wanted here," etc.) and threats (to beat me up, to call the police, attempts to remove my clothes from the dryer, etc.) by another guest in the hotel laundry room. The incident lasted approximately one hour. Hotel staff admittedly witnessed the disturbance but failed to intervene. An off-duty employee eventually intervened. I filed a formal complaint that evening.
On February 2, 2026, management acknowledged the incident via email and confirmed the guest was removed. However, they did not address the systemic safety failures, retrain staff, or provide any remedy for the breach of the Warranty of Habitability under Colorado law (C.R.S. § 38-12-503). I informed the hotel of my intention to pursue legal action.
On the morning of February 4, 2026, I filed a lawsuit against the hotel in Denver County Court (Case No. 26S00101). The court granted my Motion to Sue that same day, and a Summons was issued. While I was away from the premises, hotel staff entered my room without notice or court order, removed all of my personal belongings to the hotel lobby, denied me access to my belongings "without an escort," and confined my cat. This constitutes an Illegal Lockout, a Class 1 Misdemeanor under C.R.S. 13-40-104, and Retaliation under C.R.S. 38-12-509.
Denver Police Department officers from District 6 responded to my call after approximately three hours. The officers on scene included:
- J. Giannotti (#21013)
- De Leon (#21034)
- Matthew Van Portfliet (#14034)
- Jordan Peterson (#14088)
The officers initially refused to take a report for the illegal lockout, instead threatening me with arrest for asking questions about my rights. Despite the officers' initial refusal to assist due to the matter being "civil" and not "criminal," they eventually complied with my requests and helped me obtain my cat, who had been locked in the room, and retrieve my belongings from the lobby. The incident was later re-categorized internally by DPD.
The official court docket for Case No. 26S00101 explains the events leading up to the February 4, 2026 lockout. I later filed for voluntary dismissal without prejudice, so that I could remove the case to District Court to sue for a larger sum due to the events on February 4th. The motion was granted on February 18, 2026. However, because I plan to soon relocate out of state due to new employment obligations and cannot be distracted by prolonged litigation, I will not be refiling in the near future. This dismissal was without prejudice, meaning I reserve the right to refile these claims at any time. The court's grant of my Motion to Sue in Pauperis acknowledges the merits of my filings, as in forma pauperis is not granted for frivolous filings.
What future guests should know: The hotel is owned by Dikeou Realty LLC. Local management and staff appear poorly trained on Colorado landlord-tenant law, as well as protecting guests in matters of harassment. The timeline is critical: the illegal lockout occurred following my expression of intent to sue and while I was in the process of filing the lawsuit--which is textbook retaliation.
If you report safety issues, be prepared for retaliation, including illegal lockouts. The Denver Police Department may initially refuse to take reports on such incidents. Be persistent, cite the specific statute (C.R.S. 13-40-104), and demand a report number.
I have chosen to move on with my life, but I wanted this record to exist for anyone considering staying here. If I ever return to Colorado or have the time to pursue this further, I will refile in District Court.
