THIS IS AN UPDATE post ON THE SAGA OF GALLAGHER CONSTRUCTION COMPANY. AVOID DOING BUSINESS HERE!!! OR MY STORY COULD BE YOUR NIGHTMARE TOO!
If I could give negative stars, I would. So this nightmare will not end. All I would like them to do is to do what is stated in the contract that we both signed after waiting a year on a project that should have taken 3 WEEKS, AND A YEAR LATER, IT IS STILL NOT RESOLVED, and fix any damage they caused to my house BY THEM which is extensive because of doing work not up to industryy standards.(YES I HAVE PICTURES).
Interestingly enough, I also was given notice from a worker who stated they had not been paid. I contacted a lawyer regarding this issue and the fact Gallagher was in breach of contract after a year later on a "three week project". While we were playing phone tag with my lawyer, I got a mechanic's lien notice from Sunbelt rentals that they were going to "put a lien on my house" if Gallagher did not pay them for the use of their services (boom and scaffolding in the post mentioned earlier Nov 2017). I paid Gallagher for their services per the contract. The rest will be paid per the contract when they finish the job per the contract. This was very upsetting.
Sunbelt Rentals is the company that Gallagher subcontracted with to rent scaffolding and a boom. After much communication with Sunbelt, I was told I was not the only one who got a notice and they had NOT been paid "one penny" on my project AND others PROJECTS. I AM NOT ALONE! This is not just "my issue" on "my project". Other clients of Gallagher construction company are dealing with the same issue, according to what I was told by both Gallagher and Sunbelt.
I paid Gallagher per the contract. I have copies of all money paid. Gallagher has not paid Sunbelt Rentals.
This story of not doing work on time and quality work and "fixing" the problem is a consistent repeating problem and is not an "isolated event".
Problem: Having a contractor, like Gallagher, not pay their subcontractors/workers/material supplies, can result in the OWNER PAYING TWICE - SEE #5 below.
1) So, in order to do a just review for YELP, I researched contractor laws. My comments are in ALL CAPS of what has happened to me.

"One of the classic warning signs that we see is when the homeowner starts noticing that the project is delayed and work isn't progressing as scheduled.YES, CHECK, THIS IS WHAT HAPPENED TO ME. Notwithstanding the delay, the contractor is asking for either more money or advance payments so he can "keep the project going."YES, CHECK, THIS IS WHAT HAPPENED TO ME. THEY ARE NOW REQUESTING $5000 MORE DOLLARS TO PROCEED. "
3) "When this happens if the homeowner doesn't have a good contract - someone trustworthy to consult with on the legal aspects of the construction project - the temptation is usually great to just make an extra payment so the project will be over.YES, CHECK, THIS IS WHAT HAPPENED TO ME AND THEY ARE PUTTING EXTREME PRESSURE ON ME TO PAY THEM MORE MONEY WHEN CONTRACT STATES I PAY THE REMAINDER ON COMPLETION OF WORK."
4) "All too often, what actually happens is that instead of moving the project along, it is further delayed. YES, CHECK, THIS IS WHAT HAPPENED TO ME. The homeowner is out more money and subcontractors who the contractor hasn't paid (and who the homeowner didn't even know about) start calling the homeowner.YES, CHECK, THIS IS WHAT HAPPENED TO ME. They are now asking the homeowner to pay them directly, and threaten to file liens against the home if they don't receive payment.YES, CHECK, THIS IS WHAT HAPPENED TO ME.
5) "Because of statutory mechanic's lien rights that subcontractors have, if a homeowner isn't careful about having a good remodeling contract, and in how payments are made to the contractor, that homeowner runs the risk of having to pay twice for the work that is done YES, CHECK, THIS IS WHAT HAPPENED TO ME AND I DO NOT WANT TO HAVE TO PAY TWICE-- once to the contractor and once to the subcontractor who has recorded a lien against the property."
In my "lawyer letter", sent by certified mail, in January 2018, I asked , among othee things, that Gallagher:
1)A complete list of all material, contractors and suppliers, and sub-contractors, suppliers, used on this job. 2)We also requested they been paid in full and sworn statements stating that AND THAT THEY PAY SUNBELT AND SUBCONTRACTORS, AND OTHERS IMMEDIATELY IN FULL. WE. ARE STILL WAITING FOR A SIMPLE REQUEST per my lawyer. AM TRYING TO WORK WITH THEM, BUT THIS DOCUMENTATION IS CRUCIAL AND REQUESTING THIS INFORMATION IS WITHIN THE LAW AND THEY SHOULD PROVIDE THIS PER THE LAW!!
