After reviewing my receipt, I noticed what appears to be a questionable method of applying card processing fees. Rather than listing any processing fee as a separate line item, the restaurant appears to incorporate the fee directly into the price of the food before calculating sales tax. For example, I ordered two (2) 3 Fish with Fries combos that were advertised at $12.50 each, which should have totaled $25.00. However, once I informed the cashier that I would be paying by card, the price immediately increased to $26.00. My overall order should have been approximately $48.00 before tax, yet the receipt reflects a pre-tax subtotal of $50.43, an increase of $2.43. Sales tax of 8.875% was then calculated on the inflated subtotal, resulting in a final charge of $54.91. From my calculations: Expected pre-tax total: $48.00 Charged pre-tax total: $50.43 Difference: $2.43 Effective increase: approximately 5.06% New York law generally permits merchants to pass along only their actual credit card processing costs, with a maximum surcharge of 4%, and merchants may not profit from those fees. My calculations indicate an apparent increase of 5.06%, which exceeds that statutory cap if it is in fact a surcharge. I encourage the business to improve its pricing transparency by clearly displaying both cash and card prices or separately itemizing any lawful credit card surcharge on customer receipts. Consumers deserve to know exactly what they are paying for and to have confidence that all charges comply with New York State law. The food keeps me coming back, but the billing practices leave me with significant concerns. I hope management reviews these issues and adopts a more transparent and compliant pricing policy.
