Mishandling Escrow Money (Bad Business). Looking to file complaint with Board of Realtors!
This review is for Lisa Berge (agent) and Vincent Koo (Broker/owner). My wife and I were in the process of moving from the west coast to Queens, NY. My wife reached out to a few real estate agents inquiring about their rental listings. We received a response from Lisa, so we decided to work with her exclusively.
We decided to make a special trip to NY to view properties in person. When we met Lisa, we found out only a couple of properties were setup for us to view, and viewed only one that day. Not exactly what we were expecting after traveling over 2,500 miles. She managed to setup a couple of additional properties for us to view during that weekend. Before leaving NY, we decided to at least submit an application for one of the properties. We gave Lisa a check as a deposit for the property to show the owner we were interested in renting the apartment. We found out that the owner wasn't sure if she wanted to accept the offer or not. The owner stated that she wouldn't use the lease submitted by Lisa and needed to speak with her attorney prior to making her decision. Since our time was limited, and the owner did not sign our lease, we decided to pull our lease on that particular property. Lisa notified the owner and our search continued. At no time did L,isa mention that there was a request for our deposit from the owner, nor did she mention that EXIT REALTY would keep our deposit.
Fast forward a month, we are now traveling across country heading to NY. We have been working with Lisa to secure an apartment. My wife spoke with Lisa and and asked her to setup a Monday appointment with a property we had found on our own. We were told that Lisa had a funeral to attend on the following Monday, and would request representation from another agent. On Saturday night we followed up on the appointment and were told, via text, that she was working on it. On Sunday night, no word from Lisa about Monday's appointment, so my wife and I decided to take our belongs to storage since we didn't have a place yet. On Monday around 10 am we received a call that the property in question had been rented over the weekend. At this time, she noted that she had a property we could see at 11 am, but upon further review, she noticed there was a requirement that we didn't meet. She stated that she would call us back. Due to the fact that Lisa had been told that we would be available between 11 am and 2 pm, we continued to unload our truck. Later that day we received a text stating that an appointment had been set for 4 pm along with an address. We realized that we wouldn't be able to make that appointment due to the amount of unloading we still had to complete. At this time we texted Lisa and requested a later showing time. Had she called to confirm our availability, we could've let her know where we were in the storage process. We were told that the time could only be pushed back thirty minutes. At this point we realized that we could not leave our belongings. I was scheduled to fly to Orlando for business the very next morning, a fact previously known by Lisa. We asked Lisa if we could set aside time on Saturday when I returned from Orlando. Lisa replied back that she felt that we did not respect her time. Surprised by her response, my wife replied letting her know we disagreed with her statement. After all, this was coming from a realtor who wasn't supposed to be available due to a funeral. We decided to part ways. I'm thinking to myself how we just spent 4 days driving across the country, with one day to unload our moving truck and secure temporary housing, but she felt that we wasted her time.
A few days later, my wife saw that Exit Kingdom Realty decided to deposit the check we gave Lisa a month ago. So my wife called Lisa, and she said that the deposit was non-refundable. We looked at the agreement, but it was never signed by the owner agreeing to rent us the property. We realized that Lisa was doing this out of spite. So I decided to call the owner/broker Vincent Koo. Instead I spoke with the office manager. I told her the story, and she said she would talk with Vincent about the situation. She asked if Lisa continued to show us properties after the original deal with our escrow deposit did not go through. I said yes and provided her proof.
At this time, I thought that Vincent Koo (owner/broker) would see that Lisa did this out of spite, plus, there could be an issue with holding an escrow check for a month without depositing it. To my disappointment, Vincent Koo decided not to return my deposit. At this time, I have decided to file a complaint against both of them. Mishandling escrow money is a big NO NO. At this point, I want to make people aware of the potential risk you may face with Exit Kingdom Realty, and I would suggest you find another real estate company before using them. read more
