CONSUMERS BEWARE! PUBLIC SAFETY AND SECURITY ANNOUNCEMENT:…read more We weren't coerced or bribed with things of value to write a positive business review of Auto Merchants Inc. This is an authentic business review of our interactions with the owner/Sid S. and his employee/Octavio C. over the previous 900 days, as it relates to the owner's grossly past due insufficient funds check. NOT REWARDING DISHONORABLE CONDUCT: It's more important than ever for a consumer to do their due diligence in sufficiently investigating the individual or business they are considering investing their hard earned money with, and only reward individuals and businesses that operate ethically, legally and constitutionally at all times. This objective, to the best of our knowledge and recollection of facts and/or opinion based business review will assist in that mission, as it relates to Auto Merchants, Inc., for the best predictor of future behavior is past behavior! INTRODUCTION: An insufficient funds check is a serious civil and criminal offense that is actionable under Texas Business and Commerce Code 3.302 (holder in due course) and Texas Penal Code - Chapter 31 -Offenses Against Property (THEFT). This legal and constitutional protected business review is designed to kindly compel Auto Merchants, Inc. to comply with Texas law, and the fiduciary responsibility of their company established by the Secretary of State, and immediately resolve the balance of their grossly past due insufficient funds check on file at Lee's Check Cashing without further subterfuge and/or obfuscation and/or delay. 1. Check date: 5-2-23, check # 5980, amount: 3000.00. Receiver of funds: Octavio C. Total balance due NOW: 1500.00 + 900.00 (reoccurring administrative resolution fees) = 2400.00. FACTS OF CASE AND CONDITIONS OF THE LAW: On 5-2-23, Auto Merchants, Inc. issued a check to an employee/Octavio C. for duties/services performed. The employee cashed the check at Lee's Check Cashing, and the check was returned to the check cashing establishment due to insufficient funds, because the check issuer intentionally stopped payment on the check within hours of issuing the check. Subsequently, over the next 150 plus days, the owner of the check cashing establishment contacted Auto Merchants Inc. and/or the receiver of funds in order to compel them to comply with the aforementioned Texas check laws and resolve the grossly past due insufficient funds check. Due to the refusal and/or failure of Auto Merchants, Inc. to comply with Texas check laws, their unpaid check was delegated to the authority of the Loss Prevention Department to facilitate immediate resolution. The owner alleged (without proof) his account was 'hacked," as the justification why he stopped payment on his check. He alleged the employee was given a 3000.00 dollar replacement check and snapped; "you better check our records!" If true, he did so without using basic business common sense, in first verifying the legal holder in due course of his returned check, and if the employee deposited the initial check into his bank account or cashed the check at a check cashing establishment. The employee was interviewed to verify the owner's claim. The employee alleged he was confused and thought the 3000.00 dollars was his, since the check was written in his name. The investigator helped him realize how preposterous his claim was received, so he confessed to intentionally embezzling the 3000.00 dollars in funds that were legally required to resolve the insufficient funds at our check cashing establishment. The owner was informed multiple times in writing and text, if he paid the employee to resolve his insufficient funds check, and he refused and/or failed to resolve the check with the legal holder in due course, his check is legally unpaid, and he is legally required to immediately resolve his check at our check cashing establishment, and he may file embezzlement charges against his employee for the alleged theft of his 3000.00 dollars if he refused and/or failed to return the funds he allegedly stole from him. The owner defiantly and irresponsibly refused and/or failed to comply with Texas check laws, and instead offered to pay 300.00 dollars every two weeks until paid in full, lending to the reasonable speculation the real reason he stopped payment on his check is not because his account was "hacked," but because of poor money management and/or lack of sales revenue due to poor, substandard business practices. At the point the owner's unpaid check was approximately 250 days past due Texas law, he finally made one measly 300.00 dollar payment on 1-24-24, and subsequently four more 300.00 dollar payments on 2-8-24, 3-6-24, 4-3-24, 5-8-24 and abruptly stopped without the consent of the victim, leaving a balance of 1500.00 dollars for over 575 days; in the process ignoring two certified letters, and over 100 text and phone calls to compel him to resolve the balance.

What could have been a very stressful situation was completely transformed by the people here. Chris, the General Manager, personally came out to check on me and make sure I was okay, then drove me himself to the main lobby so I could use the restroom and get out of the cold. The team even offered to change my tire, but I declined only because I already had a USAA tow truck on the way. As I was heading back, Dean kindly helped me get a coffee and made sure I was comfortable before returning to my car. During that time, Kay, one of the service technicians, stood by my car in the cold to watch it in case the tow truck arrived while I was away. I was not a customer and wasn't driving their brand, yet every person treated me with dignity, patience, and genuine care. No pressure, no sales pitch--just people helping another person when they needed it most. Thank you, Chris, Dean, and Kay, for turning a frightening moment into a powerful example of what true hospitality and professionalism look like.

BMW closes at 8 M-F because they actually understand customers work for a living and 6pm doesn't work for customers. Called Park Place Lexus the next day to make an appointment to drop off my car to change out my tire and perform routine maintenance and they tell me they don't have ANY loaner cars at the time and won't have any for FIVE days. This is a CAR COMPANY. How on earth do you not have any cars available to loan out? How incompetent do you have to be to mismanage your loaner inventory so badly that you have to turn away customers because you don't have cars? For an (alleged) luxury car company, this is completely unacceptable. BMW would NEVER have a problem like this. Looks like I will be switching back to them if this is the kind of unprofessional service Lexus offers.

I now lease a Prius Prime, and while I love this car, dealing with TFS has recently become a nightmare. The problem started a few months ago when I began receiving letters, emails and calls from TFS about missed payments even though I pay my bill monthly with autopay. I called and discovered TFS was erroneously applying my current payments to my previously leased RAV4 that I returned to the Toyota dealership when I leased my new Prius Prime. I thought the matter was resolved--but TFS' letters, emails and calls continued. Then on April 27th, I got another "collections" call. Annoyed, I stopped the conversation and asked the agent to verify my payment history, and to check if my payments were correctly being applied to my current car vs my old car. She heard me out and took the time to verify my payments were still being applied to the RAV4. She had me hold, and took the initiative to escalate to management to fix TFS' internal problem, and then suggested checking with my bank to verify the correct account # is referenced in my auto-payment. While I'm waiting to hear from my bank, I want to be clear, this agent was terrific, and I'm quite confident she correctly communicated to management my payments must be applied to my Prius Prime. Apparently management dropped the ball a second time, because since Monday (four days ago!) I've received four TFS calls regarding missed payments. Why am I still getting these calls? Has TFS' Accounts Receivable dept. told collections to stop bothering me? Or do they not know how to stop auto-letters, emails and calls once they know they've made a mistake? Is this a back office internal collaboration problem? Do I need to worry about hits to my credit rating? What is going on with TFS? This is no way to treat any customer, much less one who has done business with Toyota for 46 years.

There was some minor issues but the most glaring was the check engine light. David said the issues would be taken care of, go to lunch and come back in a couple of hours. He called me and said they needed a part that would not be there until Monday. David paid for my flight home and said the truck would be shipped to me. I received the truck late the next week. When driving from where I received the truck, the check engine light came on. I notified him of this issue and he said to have it fixed locally and he would reimburse me. It has been several months and many texts and calls and still no reimbursement. Up until this point, David lived up to his word but I am extremely disappointed to have to write a partial negative review due to not receiving this promised reimbursement. In addition, the check engine issue took two times to resolve, the second requiring an additional cost which I decided to absorb thinking I would get the promised reimbursement. In closing, David did live up to his word on everything until this reimbursement issue so I can't give a 5 star review due to this

As I was leaving the parking lot my wife and I saw the Hyundai Calligraphy and it was a great looking SUV as well. We parked and as we were walking to the dealership front door we ran into Manny Rios who introduced himself as a Product Expert. My wife and I had a smaller SUV from a competitive brand that we had bought to fit in our 3rd garage door that was 2 years old and we also had a larger SUV from another competitive brand that we gave to our son. We have driven all the larger SUV brands in the last year with the exception of the Hyundai. We knew what we liked and were well versed on pricing and trade in values. Manny spent a lot of time with us and answered all our questions and then we took a test drive. We were impressed! The Calligraphy was incredible! After the drive Manny and I reviewed all details such as pricing, incentives and service. I was a V.P. of sales for 30 years with some of the larger companies in the US. I was extremely impressed with the job Manny did. We bought the Calligraphy. Larry Lamarre

Transmissions can be expensive problems so I'm so glad this will be handled while it's well under warranty. I limped home with it and scheduled their next available appointment, 7:30 am Monday. Monday morning, the car drives ok on the way there. The service guy said he wouldn't be able to look at it until *at least* Wednesday. (Umm, ok, why isnt Wednesday your next available service date then?) I asked for a loaner. None were available, but he said get a rental and Hyundai will reimburse you. Days later the service guy called and said they couldn't replicate the problem. Driving in Dallas traffic waiting for my car to have no power again wasn't a great solution, but it was their only one. I understand they can't fix what they can't find, but the answer is look more, not stop looking. I call Hyundai to get my reimbursement and they won't because the work wasn't done. I call the service guy to see how people have handled this in the past and he had no advice. I said if I knew this was a possibility, I definitely wouldn't have left it for the first 2 days while no one was doing anything with it, or I would have re-scheduled it when they had a free loaner available. Service guy said he couldn't schedule a loaner. How I would have handled it: 1. Advised me there was a possibility the rental wouldn't be reimbursed when I dropped it off. 2. Show empathy for my side of this. My car isn't fixed. I'm out some money and a lot of hassle. 3. Escalate the issue. 4. Offer a creative solution. "This is an unusual situation, so I really went to bat for you. We tried, but we can't do anything about the corporate reimbursement policy, however, we want to do something for you at the dealership. I asked my boss if I could offer you 4 free oil changes. Thats about what you spent on the rental. We value your business and I hope this shows that." Or something, anything... just convince me you care. I've bought 2 Hyundais in the last 6 months and owned 5 total. A "so-what" attitude and $411.75 for a car rental is what it took to stop that streak.
