However, he made it very clear that his fee needed to be paid first and it was necessary that we bring him a certified check for $4,500. the next day. After making payment as agreed, we waited to hear from him. After one month and hearing nothing, we finally had to contact him. He brushed us off with a story about the matter taking more time than expected and that he needed additional documentation from us, etc.. So, we sent him additional documentation and waited again. This went on for nearly a year with no progress whatsoever. We met with him in person, called on the phone, sent E-Mail and nothing was accomplished but delays, excuses and talking. In the end it was necessary to file a formal complaint with the Arizona State Bar to resolve this problem with Bybee. The resolution by the Arizona State Bar was that he (Bybee) submitted a bill for all the communication with us (delays, excuses and BS) and he (Bybee) was to be entitled to payment for his time and we would receive the remainder to be refunded from what we paid him. We ended up with $1,000. refunded out of the $4,500. paid to him. On top of that, the legal matter we went to him about was then past the statute of limitations and ended up not resolved. Bybee was NO HELP to us and completely UNPROFESSIONAL. Is he a swindler? Of course we do not recommend him and suggest if you are in need of a lawyer in AZ, look elsewhere. It should also be noted that you can not trust the Arizona State Bar as in more than one instance, we have found that they support their own and could care less about the public they serve.

He said we have a no-brainer justification to retain the security deposit, however, once the tenant responded with a strong and threatening letter, the approach changed significantly. Instead of guiding us through a clear strategy, the communication became reactive and somewhat discouraging. During a phone call, he expressed frustration about the direction of the case and questioned decisions that had previously been discussed, such as raising certain damages. What concerned me most was the lack of consistent advocacy. The tenant appeared to self-advocate more effectively than our legal representation. There was little meaningful negotiation achieved on our behalf, and the matter ultimately resulted in us returning the full $2,500 security deposit, despite initially being advised otherwise. We paid $1,500 in legal fees but saw no value in terms of negotiation or outcome. While Attorney Richard Elley seems knowledgeable about landlord-tenant law, the level of advocacy fell short of expectations, and the tenant appeared to advocate their position more effectively than our legal representation.
