I have zero back bone and am very kind on the phone so this made me take a step back and think whether or not I should go with this company for renting. She was so nasty towards me that I almost hung up on her but again, zero back bone. She again, started berating me about how I keep saying "the retreat, the retreat" and went off on me for a good minute, ending it with "well now we figured it out." She harshly told me that there's no availability and I asked her if there would be any rentals opening up in the next few months and she told me to go to Evergreen Live and look because there's rentals popping up every day and sarcastically ended the call "good luck with your rental search" and hung up. If this is who is advertising your properties, I really don't want to know who is working on the premises. Anyways, I did look on their website and they had one property listed for this particular area that I was originally inquiring about. Not only was this woman insanely rude, she also lied about the rental not being available. Again, I'm extremely kind when I speak on the phone and have never ever given anyone attitude (including health insurance issues, we all know how that can be). I was shocked by her treatment towards me. Because of how I was spoken to on the phone, I have zero desire to give this company any money.

While I understand that the lease contains a written notice provision, what I find troubling is the manner in which that provision has been applied under the circumstances of my tenancy. From the beginning of the leasing process, I made it clear that the apartment was needed only for the duration of my son's temporary internship and that there was no intention to renew or extend the lease. In fact, that understanding was the entire reason we entered into a short-term lease despite paying a premium rate. Because our intent was openly communicated before the lease was even signed, it is difficult for me to understand how the purpose of the notice requirement was not already satisfied in substance. What makes this situation feel predatory in nature is the appearance that the company is relying on a technical notice requirement to impose additional financial obligations even though management was aware from the outset that we would be vacating at the end of the lease term. From a resident's perspective, it appears that actual knowledge of our intentions has been disregarded in favor of a procedural requirement that ultimately benefits the property financially. Had Cody or Lesa explained during the leasing process that a resident signing a three-month lease but only staying two would effectively need to submit a notice almost immediately after move-in to avoid additional rent, I would have done so without hesitation.

The returning contact was Vito Raymond with Metro 512 Realty a.k.a. 512Living a.k.a. The 512 Group. Vito met me onsite at Mission South to show me apartment 112. When I arrived he said that unit had been leased but he could show me 109. Unit 109 left much to be desired. You could tell they were working on it, but you could also see the unit suffered years of maintenance neglect. Still sensing my hesitation, Vito called me back to come look at a finished unit at Mission South the next morning. This unit looked good, but sadly it was on the second floor. Due to a current disability, I need to be in a first floor unit or have access to an elevator for upper floor unit occupation. I asked Vito if some basic updates could be made to the 109 unit before I applied & he said that my list items were already on their list to take care of. I informed him that I was not available for any move-in until at least March 13, due to my being out of the country. I don't think that message hit home with anyone, because as I was out of town, the pressuring messages started flooding in. Multiple texts from Vito to which I replied that I was still abroad. I asked if I could see the unit before signing the lease & if it didn't work, for whatever reason, if I could get my security deposit back. His reply was "Yes that can happen as long as you don't sign the lease first. So pay the deposit and tell Loren our property manager that you want to see the apartment before signing the lease". The very next day I got an email from 512Living - Mission South's assistant manager Marisa Garcia. "The security deposit and admin fee payments are missing in order to hold the unit & send the lease.", she explained. In fear of not having a place to live when I got back to Austin, I reluctantly paid the admin fee & the security deposit via an online portal on March 8th. my mistake was assuming Vito had spoken to them about my being abroad & about my request for the deposit refund. Friday 3/15/24, I texted Vito that the unit wasn't right for me and that I wasn't going to make our meeting or sign the 12 month lease with Mission South. He wished me luck & asked me to reach out to Loren, the manager for Mission South & employee of 512Living to get my security deposit refund. I called & left a message with the admin on shift. Later that day I got an email from Loren reading ..... "Mary- I've attached a copy of the application for your records. Your application was received on 02/26 & approved on 02/28 when your guarantors application was submitted. The deposit was paid on the 8th, & the lease was sent the same day- the unit had been held since the 8th. On page 6 of the application, it states in paragraph 3 & 6 that we may keep the application deposit as liquidated damages if you don't sign the lease or withdraw your application. I know Vito mentioned you weren't ready to commit to a long term lease. I can ask the owner if they would consider a shorter term lease if you would like; let me know and I can reach out to the owner. If you have any questions in regards to this, please let me know. -Loren" Notice that in the email above Loren improperly refers to my security deposit as an application deposit. I paid a security deposit, as referred to in the application. I did not ask for a 6 month lease that she attempted to have prepared for me. I explained to her that Vito mentioned that the security deposit was refundable if I didn't sign the lease & asked her to have the owner call me. After two days of no reply I followed up with an email explaining that I am not interested in signing a lease & that I do not feel comfortable doing business with a company that allows misrepresentation of terms from an agent regarding the refund-ability of security deposits. I also asked them to send an itemized & dated list of any liquidated damages suspected to be associated with this transaction. I still have not received this. Loren replied "although the application specifies that we can retain the application deposit as liquidated damages in case of withdrawal or failure to sign the lease, the owner has agreed to refund half of your application deposit, totaling $537.50." Again incorrectly referring to the security deposit as an application deposit. There are no defined terms for clear understanding. They change the deposit term to suit their needs. This is absolutely poor real estate practices & every realtor I have spoken to says they are operating incorrectly by Texas law. Even Vito texted confirmation that he "did say the security deposit was refundable and that has always been their policy". I took the partial refund, but I am still waiting on the receipt for damages. They are now past 30 days as required by law in the state of Texas to produce this. I am still working to get the rest of my money. BUYER BEWARE!

It's unfortunate with all the good reviews for this place, we did not receive that same service…read more However, this is specifically about Michael Said who represents himself as part of this business. We were waiting on a house to move into and needed a temporary place to stay. Initially we felt fortunate to find this place as it was reasonably priced and we could rent it for six months. It was freshly painted but infested with cock roaches. Each time we notified Mr. Said, he did ultimately arrange for pest control. There were light switches that did not work, a closet door that would come off it's rails, missing drawer handles and we would find mice/rat feces in some cupboards in the kitchen. Mr. Said would have a maintenance person come out and fix things but typically not without multiple requests. But, we were only going to be there for a few months and we figured we would just tough it out. We barely unpacked since we were going to move again in a few short months. More than 30 days prior to our lease ending, we did notify Mr. Said that we would be leaving and not extend the lease. We also requested a "walk through" with Mr. Said. While he acknowledged the 30 day notice, he never responded to the walk through. On December 19th, more than ten days before the lease would end, we vacated the property but Mr. Said would not agree to meet. Ultimately, we left the keys under the door mat on December 21 as per Mr. Said's request. This was a full days before the lease was to expire and more than enough time for Mr. Said to walk through himself or with me to identify anything he felt should be addressed before the leased ended on December 31. But Mr. Said did not do this. On January 28, 2023 we received our refund and it was minus: - $150 for cleaning - $300 for "touch up paint" - $300 "yard cleaning & dead landscaping replacement" Given the constant cock roaches and rodent feces, I find the $150 cleaning to be excessive but we are not asking for that back. However, the place was newly painted and we never hung anything on the walls. There was absolutely not damage done to any walls that would necessitate any "touch up painting". The $300 is absurd and the lease specifically states "normal wear and tear expected". But there were no areas that needed touch up paint. It was winter when we moved out; Austin had just experienced several days of temperatures in the teens. You cannot possibly ascertain between landscaping that was dead versus dormant. However, there is no landscaping so I'm not even sure what they are claiming. There are two trees in the front and a big tree in the back. There are no shrubs, flowers or what they call "landscaping". While there might have been leaves on the ground, that's unavoidable at that time of year and no matter how often we could have cleaned up leaves from the trees, there would always be leaves. But there was no landscaping that arises to the $300 deduction Mr. Said took. I am a disabled Veteran who served 30 years for this country and it's appalling when people like Mr. Said take advantage of people. Again, I am posting this as Mr. Said represents himself as Realty Austin and for anyone who might do business with them, just to be aware of the practices of some of their people, specifically Mr. Said.
