On August 2, 2021 at a 10:02 PM CT, I entered your establishment, located 1500 yards from my front door just as I have done many times in the last 10 years. Your bartender Kassandra, refused me service for wearing what she referred to as a "wife beater shirt". I left the bar and asked a Latino patron, who was getting into his car after participating in your pool league there and who had the same shirt on if he was refused service at your establishment and he replied: "No".
Your establishment was hosting and serving other African-Americans, Latinos and others. Your employee was not discriminating against me base on race. As a black transgender, I entered your bar wearing a T-shirt with no sleeves, ballet flats along with a purse and Kassandra used my t-shirt as a transparent reason to deny me service.
By her actions, Kassandra placed your establishment in clear violation of Dallas City Ordinance 46-6-1 which states:
"SEC. 46-6.1. UNLAWFUL PUBLIC ACCOMMODATION PRACTICES.
(a) Discrimination in public accommodations. It is unlawful for any owner, proprietor, or lessee of any place of public
accommodation, because of sexual orientation or gender identity and expression:
(1) to directly or indirectly exclude, segregate, limit, refuse, or deny to any person any of the accommodations, advantages,
facilities, benefits, privileges, services, or goods offered to the general public at that place..."
Your employees resort to a using a specious dress code has also violated Dallas City Council Ordinance 31-3 Prohibited Activity, to wit:
"A person commits an offense if he or she:
discriminates against, withholds from or denies a person
any of the advantages, facilities or services offered to the
general public by a place of public accommodation
because of race, religion, sex, color or national origin.
or refuses admission or expels from a place of public
accommodation, a person for noncompliance with a dress,
grooming or identification requirement that was not
previously posted in writing in a conspicuous, clearly visible
location outside each public entrance. "
Your business has no such posting.
Your employee may be considered to be acting in your name and/or at your direction if they continue to perform these activities. This exposés her, you, your business entity, partners, investors and/or associates to legal sanctions should this activity continue.
It is in your best interest to retrain, re-assign or dismiss such a person actively violating the law. This will be your only notice. It is fairly easy to determine your business is violating city law in this manner. As a wise businessperson interested in keeping the good will of your neighbors who patronize your establishment act now in the best interests of your business presetnly and in the future by positive action to rectify this discriminatory and abhorrent behavior immediately.
No business can expect to operate long within a community and carry on active discriminations against members of that community. Your business location has a thriving and politically active, middle class LGBTQ+ community with many allies among business, religious and political organizations that are the backbone of the small and medium businesses you serve at CK Billiards and Bars.
I have enjoyed the hospitality of your bartenders many times over the last ten years I have patronized your establishment and am shocked by the high handed, sexist and gender identify based your employee, Kassandra has evidenced. read more
