What Mossy Nissan Escondido did to my family and I, is criminal. They stole my family's only…read morevehicle over a giant warranty denial cover-up, ruining my life and credit. Their own paperwork proves they cheated and retaliated against me. My family was completely blindsided by their deception, and they still refuse to show transparency or any sort of accountability. Two days after drop-off, Mossy ordered $8,348.56 in unauthorized parts without a single mention or diagnosis (Invoice #E001064663, March 11)--6 days before even giving me a written estimate. I only authorized a $180 diagnostic at that point for what I believed was a fuel pump issue. The day they placed this unauthorized order, Service Manager John Hart texted me claiming they hadn't found the issue yet and that it would take another couple days. Worse, their inspection report shows the parts they claimed were broken actually passed inspection and others were never tested. They never diagnosed my original issue. When I disputed the bill and opened BAR and Consumer Affairs complaints, Hart retaliated by calling the police, falsely claiming I stole their courtesy car. He lied that they demanded it back, but USPS tracking proves I never received their letter. I had email correspondence the day before I of him extending my rental date and even allowing me to keep the courtesy vehicle longer at a $50/day rate. He broke his written promise not to escalate during active state and internal investigations. After police retaliation failed, he attempted a fraudulent DMV lien sale. I opposed it and filed a fraud report with the DMV, forcing the DMV to lock my title so they couldn't sell my vehicle out from under me and go to court over the matter (which they had 30 days to do so, and nothing was ever filed in the court system) Over six months later, they still refuse to provide serial numbers or let me access my car. I don't know what was installed. Paperwork shows they ordered a defective, discontinued first-gen transmission that has been obsolete and not even authorized for use by Nissan North America, then switched the bill to a the 2nd gen transmission (what my car was originally equipped with) but instead, was a refurbished unit...not the brand new factory transmission they told me I was receiving. To make matters worse, when I blocked the fraudulent lien sale, NMAC froze my account to blocked me from accessing and making my on-time payments, even though my car was 97% paid off. I was told I won't receive access to my account unless I pay the fraudulent repair bill. They then laundered this fraudulent repair bill onto my credit profile, labeling it a "repossession fee" on my credit report, and let me be clear, my car was never repossessed; it sits on Mossy's lot today under an unlawful conversion. They completely manufactured a fraudulent default and repo just to harm my family and I even further. They destroyed my livelihood to cover their illegal paper trail. I spent over 6 months demanding answers and asking basic questions any reasonable person would have wanted answers for, especially after noticing all the red flags from the incomplete paperwork they did provide me. But the dealership, mossy, Nissan North America and NMAC, completely stone walled me and I was met with complete silence. Consumer Affairs (that I filed a complaint and opened an investigation with) suddenly backtracked and claimed zero authority or ability to help after they caught wind of the service manager filing a false police report against me, but only after months of them leading me on and making me believe they were looking into and investigating my claim. My life has never been the same because of what mossy Nissan Escondido did to my family and I. They stole much more than just our family's only vehicle. They stole our livelihoods, our dignity, and caused an unimaginable amount of irreparable harm that all stemmed from them illegally denying our warranty coverage over speculation and made statements stating things like "may have caused damage" and repeatedly told me that I have a CVT transmission that was listed on the estimates, final invoice, email correspondence, inspection reports, literally everything..,,,when fact of the matter is, I have a 9-speed, not a CVT. I won't stop spreading awareness until this is made right. I have been a lifetime customer of Nissan and my family members as well, we didn't deserve this, no one deserves this.
