I have a 2016 Premium Escalade (fully Loaded) with 28,057k miles and zero damage which was damaged by Platinum Towing on Mothers day and they refuse to pay for the damages which are now about $6,498.60 and climbing. My car is sitting at the Dealership awaiting who will pay for the damages.
I had a Decreased Power notification on my dash display when I started the car to go home (ended up being a bad fuel sensor covered by warranty) on May 12, 2019. I was in Seattle at Massage Envy and tried to leave about 6:30pm which the car was not powered properly to drive home. I used my Onstar services to get a tow from Seattle to the Bellevue Dealership for repair which was about a half hour drive. OnStar's first dispatch for towing was with Benchmark Towing. Benchmark cancelled the tow for some unknown reason and Onstar never let us know. We called Onstar and they dispatched another tow company who also called Onstar to cancel. I had to cancel my mothers day dinner at this point. Again, Onstar never called us to tell us they cancelled, we had to call to find out . Then we Called Onstar again, they Sent Platinum Towing. Kenji J from Platnium called me to tell me the last tow he dropped off damaged his truck so he had to fix it before he came to me. The 3rd dispatch, Platinum Towing, finally showed up 6 hours after my first call thru OnStar. Platinum Towing, Kenji J came with his truck and a dolly at 12:05am on Monday, May 13th. I was so tired, handed him the keys and instructions from the dealership then I went home in the loaner car that the dealership brought to me. Kenji from Platinum Towing was with his wife and said he would take care of the car and get it to Cadillac of Bellevue.
The next day, I got a call from the dealership asking me how the damage happened to the back end and the flat spot on the tire on the car. OMG!!!! I had absolutely 00000, NO, NONE, Zero damage to my Escalade. I called KJ, the guy who towed the car (I had his cell number because he called me to say he was on his way) and asked what happened. He stated "the car fell off the dolly, I was on the freeway and noticed sparks and weaving of the Escalade and had to pull over then wait for someone to come get the car" he also stated "I was in the middle lane when it happened and cars were honking at me, it took me a few to pull off the road". Why did no one call me to tell me this happened? I filed a complaint with OnStar who told me in their notes it states only tow with flat bed, No Dolly. I called Layla from Platinum Towing per KJ instruction to have the damages paid for. KJ apologized for the damages and said the tire popped which he had no control over. Layla has never called me back after many calls and voice mails.
I called Onstar to tell them what happened and to ask them why they dispatched a Tow company that has so many complaints with the BBB. I asked Onstar if Platinum has insurance, do you know about the complaints against them and WHY did you send them to ME. The person on the phone From Onstar told me that they are global including Canada (really ~ Canada is part of Global) and have too many tow companies to check everyone. This is Horrible ~ and to think I pay $35 per month to have the Onstar Service. After I explained my situation to OnStar, I was asked if I wanted to file a complaint, I said of Course. Then the Onstar person told me that they specifically stated in the instruction to have a flatbed tow and NO dolly due to the value of the Escalade (70k Vehicle!). Onstar also told me that they are a 3rd party dispatcher and have no liability as a result of any damage from a tow company.
The damages so far have climbed up to $6,498.60 which does not include checking on the driveline area for any damages. Both rear rims are damaged, trim is damaged, rear panel is scrapped up from the straps hitting, under the back of the car has damages and now the door on the right side passenger is tweaked and so on. I have 2 pages of detailed damage from the tow. Allstate insurance is with OnStar and they have been communicating between the dealer and Platinum towing. I have only talked to the Dealership so far and it's 5 days later. My car has never been in an accident or had any damages prior to Platinum towing.
Platinum called the dealership and informed them that they will only pay to replace the tire and that is it. They are now saying all the other back end damages are not from them and that the car never fell off of the dolly. Something does not make any sense. If the Escalade never fell off as the tow truck driver said, then how would the tire have a 7 inch flat section like it was drug at a stationary position? Why was the body of my car tweaked and a door is off center and so on.
It looks like I may need to seek an attorney to help me at this point. read more
