Mary Anne represented a rental property in which my husband and I were interested. The listing for the property stated "Best Qualified Applicant" would get the lease. Our own realtor called Mary Anne on a Thursday and scheduled an appointment to see the property the next day. Mary Anne told her that she had two appointments to see it scheduled before then but confirmed that if we saw it on Friday, our application would be considered by the owner. My husband and I both left work early to arrive at the appointed time. When Mary Anne hadn't arrived by 10 after, our agent called her. She said she had seen the appointment on her calendar but thought she had confused it with one for the following day, so she just ignored it -- didn't call our realtor to check or anything, just ignored it. She also stated that one application had already been submitted for a credit check. Our realtor asked if the process wasn't "best qualified," and she said yes but hemmed and hawed before confirming that a lease had not been signed and that yes, we could still submit an application for consideration if we liked it. She said she would head over. A drive that should've taken her 30-40 minutes took almost an hour. We saw the house and loved it. As I pulled out our applications and wrote a check for the processing fee, Mary Anne told us our check would not be cashed unless the first applicant's credit check came back bad. In other words, we were back-up. Needless to say, I was furious. I pointed out that the MLS listing said "best qualified," and she said simply, "I understand." No explanation, nothing. (Of course, what could she say?!) Of course, first thing Monday morning, our realtor told me "another applicant" had been "chosen." So in short, Mary Anne Green "mis-represented" (I'm trying to use the kindest possible language) the status of the property not only in her listing, but in two conversations with our realtor; she wasted our time in having us come view the property under false pretenses as to its availability; and she wasted even more of our time by making us wait over an hour for her to arrive for an appointment that had been scheduled a mere 24 hours earlier.
