The owner made a good case that…read moreextenuating circumstances caused the long delay, and he offered to continue with the contract plus some additional discounts. Under the fact set, we decided to just call it quits with US Generator. However, the owner, Bill Broocke, came across as genuine and wanting to fix things. Since I can't say they acted in bad faith, proceed if you will with US Generator, although I'd suggest a specific time-performance requirement in any contract, to encourage prompt installation. It may come down to your opinion of the owner. The three star rating indicates we are ultimately satisfied with the resolution of the issues, although obviously we still don't have a generator and are now shopping for another firm.
