Mark and Steve Nawas, owners of Darien Tire & Auto assumed I was a naïve idiot and a female to be taken advantage of. And if they did this to me, it is happening to you. Three good tires were taken from my vehicle then replaced with tires unsafe to drive on during a routine tire rotation without my knowledge while sitting in their waiting room. In June of 2018, I filed a lawsuit in small claims division at the DuPage Court House after going through the proper legal channels filing a police report with Darien Police Station followed by filing a complaint with the Better Business Bureau then the Attorney General of Illinois to recover my loss for the cost of the tires that were swapped out and replaced with substandard tires during a routine tire rotation, the first since purchasing the vehicle. After presenting case law citing in the Automotive Repair Act (815 ILCS 306) during the trial, the judge ruled in respondent's favor citing when I brought my vehicle in to Darien Auto & Tire for a routine tire rotation and wiper blade replacement, I should have had the serial numbers from the tires when I purchased the used vehicle in 2015. There were 4400 miles on the vehicle at the time of purchase. During the trial, the respondent presented an invoice acknowledging 1) this exhibit was not submitted prior to the trial within the proper time period therefore inadmissible and 2) the respondent broke the law by not providing the invoice at the time the work was preformed. Damages for 4 new tires taken from my vehicle totaled $846.50; this quote was for the same tires stolen from my vehicle presented to me by Mr. Steve Nawas, one of the two brothers and owner of Darien Auto & Tire because I was told driving on tires with different tread wear were unsafe, all 4 must be changed out. Three of the four tires had different wear, the fourth tire was originally on the vehicle; stole three, left one. The brothers worked in tandem, the other brother and owner of Darien Auto & Tire, Mr. Mark Nawas called me "Dear", smiled offering $100 to settle. My expectation was the judge would be fair and unbiased holding Darien Auto & Tire accountable for this blatant theft, discrimination and harassment in addition to putting my safety and the safety of my family in jeopardy when driving in the vehicle. For the judge not to hold the respondent accountable for his actions including court costs was a clear message. The respondent walked out of the court room snapping his fingers in my direction, laughing aloud in the hallway unaware he was on camera. The judge was up for reelection in June of this year; however submitted his resignation dated December 31, 2018.
Also noted, before proceeding with my legal options, I returned to Darien Tire & Auto telling Mr. Mark Nawas to return the 3 tires that were taken from my vehicle during the tire rotation. After I left, Mr. Nawas called Darien Police Station. An officer from Darien Police called within 15 minutes after I left the auto shop. We discussed what occurred. I told the police I did not new tires, I wanted the tires that were stolen from my vehicle. The following is why Mr. Mark Nawas called Darien Police. Appalled at the blatant theft and intention of this auto shop of putting me and my family in harm's way, I told Mr. Mark Nawas to take the flag of the United States down that hung on the wall behind the front desk, fold it properly and bring it to Police Chief of Darien Police Department apologizing for using first responders. I told him he was a disgrace and should distance himself from our flag. His response in that moment in coward's tone of voice, "This is my flag too." I followed with, "Yes sir, it is your flag; however only when you stop lying, cheating, and stealing from Americans who work hard for our daily bread will that flag have meaning."
