In speaking with others in the restaurant business, they say included in the menu price is not only their food costs, but also all their overhead costs - including credit card processing fees - so begs the questions, why do some places add a fee for using a credit card? So I did a bit of research, and here is what I found: NC is moving toward tighter regulations A 2025 bill (House Bill 13) proposes: * A 2% cap on surcharges * Mandatory disclosure at the entrance and point of sale * A ban on surcharges if the business only accepts credit cards It hasn't fully passed yet, but it has momentum. If it becomes law, it will standardize what restaurants can charge and how they must disclose it. Check whether the fee applies to all cards If the restaurant charges the same fee for: * debit cards NOTE: Happy Egg, my server told me, charges 4% to use a Debit Card * credit cards * even prepaid cards ...that's a red flag. Why: Debit card processing is much cheaper. Charging the same fee across the board suggests the fee isn't tied to actual processing costs -- it's just extra revenue layered on top of already‑priced‑in costs. Look for "cash discount" language If the receipt says: * "Non‑cash adjustment" (Happy Egg charges 4% to use a credit card) * "Cash discount applied" ...but the menu prices are already high, it often means: * the "cash discount" is just the real price, * and the card price is inflated on top of it.
