Here are the facts, you make the call. Fact: RJS was contacted, as part of a real estate sale, to provide an estimate, for the sellers, on the windows of the home we were considering to purchase. We have an e-mail dated 12/22/15 from the seller's realtor to our realtor that this estimate would be done. Fact: The Consumer Protection website lists the following: "What is an estimate? An estimate is roughly how much the trades person or professional thinks the job will cost. They must use their skill and experience to make the estimate. The actual price may be more or less, but it shouldn't be too much more - it should be within 10 to 15 percent." Fact: RJS wrote an estimate on 1/7/16. This estimate listed specific parts with the cost for each. One would think he knew the problem and could procure the parts. How else would he arrive at these details, right? By the way, we were closing on 1/11/16 so this estimate obviously was for us not the sellers because they were turning the property over to us in JUST 4 days. Fact: The invoice lists the name and address of the contractor, namely RJS Building Services, LLC as well as the sellers. No dispute here. So, we the buyers, contacted RJS to complete the repairs after we moved in. He was surprised to hear from us. According to Rob Schroeder, the owner, and I quote, "90% of the people I write estimate for, never contact me. This estimate was done as a favor to the sellers." So after several calls and follow up, we learned that the vendor, that makes these windows, has been out of business for quite some time. Fact: RJS Building services sent us a letter. It reads: "This letter is to inform you that RJS will NOT be performing the window repairs. The estimate was done to create a cost for which the repairs could be completed. At no time have I presented you or the sellers a proposal or contract to do these repairs." So, why would you provide an estimate to do work on a project you can't do? Isn't that like buying a car privately from someone and they tell you to take the car to their mechanic to have it checked out. They tell you the car needs brakes. You buy the car, return to the mechanic to do the job and they say "Oh, that was only an estimate for the buyers. I didn't mean I could or would actually do the job." read more
