Your response continues to reference a "holdover provision," but that does not override the requirement for a mutually executed lease agreement, which does not exist in this case. Under California Civil Code §1945, acceptance of rent after the expiration of a lease creates a month-to-month tenancy unless otherwise agreed in writing. No such written agreement exists here. Reframing a month-to-month tenancy as a fixed-term obligation after the fact is misleading. Additionally, I dispute the claim that a complete and compliant itemized statement was provided within the legally required timeframe. Under California Civil Code §1950.5(g), landlords are required to provide an itemized statement of deductions, along with supporting documentation, within 21 days of move-out. This requirement is strict, and failure to comply may forfeit the right to retain any portion of the security deposit. I have already requested documentation and noted inconsistencies in the ledgers provided, including duplicate and unclear charges. This matter is currently under formal dispute. I have requested supporting documentation for all charges, including the alleged "accelerated rent," which has not been substantiated with a signed agreement. The complex is quiet except for the afternoon children that play or the occasional barking of dogs. If you're not an understanding family/animal person then this isn't the place for you. The complex is very pet friendly and almost everyone has a cat or dog. I would defiantly choose Alpine Terrace Apartments if you're looking for a safer, cheaper, and more quiet environment!

The apartment search process isn't fun, it's downright miserable in my opinion, yet each time I've talked to, or gone in for the next step I've been greeted with a smile and made to feel welcome. This wasn't the case at other places I looked at. Also I happened to overhear another resident say she's lived there 11 yrs. to me that says quite a lot for a city as on the move as San Diego. Things we've noticed right off, cheerful, friendly office staff and beautiful trees, with a quiet park like area. Close to freeway and stores.
