PERRY HOMES - Meridiana - Iowa, Colony, TX
I have been given 3 closing dates for the home that I entered into a contract to purchase from Perry Homes on June 6th, 2019. The 1st date referenced in the contract was July 19, 2019. I was then told the end of July by Bobby (07/31/2019) and now the third estimated closing date is shortly after August 12th, 2019. The closing date continues to move, and I will incur cost for each day after July 19th (I'm currently living in a hotel since my lease ended July 8th). I am concerned that I may end up without the home because of the hotel cost accumulating while I wait for the home to be completed.
Today, July 16th, 2019, I spoke to Division President, Mike Sharp in regard to the hardship letter submitted yesterday. Mike was very firm, direct and uncompromising. He stated the following:
1. The contract address in multiple paragraphs that Perry Homes is not responsible for delays.
2. Perry Homes will not reimburse, provide credit or apply an incentive to help cover cost incurred as a result of the delayed closing. He (Mike Sharp) offered no solutions and admitted that he had no solutions for my dilemma.
3. When I stated that I the consumer was left to bear the cost alone Mike's response was "I'm not trying to be flipped but Perry Homes loses money every day that a house sits unsold, so we are losing money too."
4. Perry Homes will not refund my earnest money or money paid for upgrades.
5. When I asked if he would apply the July promotion of $10,000 of the purchase price to my contract to help cover cost incurred he said no he could not.
6. I advised my rate lock expired on August 16th - he had not response.
When I asked Mike if I could transfer and purchase a Perry Home that is completed he said no, I could not.
7. When asked if he would reply to my email in writing - Mike S. replied the contract is my response in writing. I asked Mike again if he would respond to my email in writing Mike said that this phone call was his response to my email. I asked Mike again if he would respond to the concerns I presented in the email he said that no he would not.
I told Mike that I am a single mother. That I am using funds set aside for closing to live in a hotel and I am concerned that I will not have enough money for closing. I asked if there was anything he could do, and he responded no, there was nothing that Perry Homes would do.
I asked if there was another person that I could speak to other then him... Mike replied, "there is no other person, the buck stops with him".
I concluded the conversation thanking Mike for his time but I'm continuing my quest for assistance by reaching out to Perry Homes. If a purchaser falls behind on closing the builder charges the purchaser a fee.... but when the builder falls behind the customer is left to do the best they can to come up with a way to pay for any lodging expense incurred and this is wrong.
Understanding that a home can not be sold unless water, gas and electric are installed I believe that Perry Homes should not have sold the home as "ready to move in for July" or given me a closing date of 7.19.2019. They should have waited until the services were installed or left the closing date open or TBD... especially knowing that CenterPoint has a history of running behind on orders (per Bobby).
**In addition to a delayed and fluid closing date, I found out that the appraisal for the home that I purchased has come in for less than the purchase price. I am hoping we could remedy this too.** read more
