My personal opinion of Kelly Landscaping and Tree Service is not very good when it comes to their business practices. I purchased a tree from this nursery and paid for Kelly to install it. It died within 5-6 months. "No problem I thought," I will just let them know so they could come out and replace it. I went back to the nursery and talked to Kelly directly. He immediately told me "no problem" and that he would "take care of it." He stated that he did not have any of the particular tree that I purchased in stock but should have some within a week. After three weeks went by and I did not hear anything from him, I paid the nursery another visit to inquire on the status of the replacement tree. Kelly was not there so I left my contact information with the receptionist to have him give me a call. This process repeated almost weekly for TWO MONTHS! Each time I came in or called, his staff would tell me that they gave him the message and they were not sure why he had not called me back. I even left messages on his personal cell phone. It was obvious that he was avoiding me for some reason... In my opinion, he is not professional at all.
About 2 months into this ordeal a replacement tree finally arrived. However, no one ever called me to let me know that it was in. I noticed the lone tree at the nursery while there buying additional supplies. Since the tree that I saw was MUCH smaller than the one he installed earlier, I assumed the replacement tree was for another customer.
Eventually, after waiting 3 months for Kelly to either call me or replace the tree, I requested a refund for what I paid for the tree and the installation. I was initially told by his employee that a refund would be processed that day (it was not). I called a week later to get a status on the refund. The employee I was dealing with told me that Kelly would not let him issue the refund and would not give him a reason why.
I was eventually forced to file a complaint with the Better Business Bureau. To my surprise, Kelly responded but his response was riddled with lies. He stated that he:
"...had one of his nursery employees call me to tell me that the tree had arrived."
This simply did not happen. No one ever called me to tell me that a tree had arrived. Weeks went by with no phone call. I then visited the nursery weekly for another 4-6 weeks to inquire without an explanation from Mr. McConkey as to the delay in the delivery of my new tree. Each time I visited, he was "not there" and his employees took my name and number to pass to him.
"...when I came to the nursery and saw the tree, I told him and the employee that I did not want the tree."
Kelly has NEVER spoken to me other than my initial visit when I reported that the tree had died. In fact, each time I returned, his employees would tell me that "they gave him the message, and they were not sure why he did not return my calls." This went on for two to three months without a return phone call which led to the above referenced BBB complaint.
"...He explained that [the replacement tree] was approximately the same size and that he was sorry that I was not satisfied, but that he wasn't going to order another tree."
Again, this is also a lie... The issue with the size of the tree was never discussed with Kelly as he has not had a conversation with me other than my initial visit. I am not sure why he would state this as it is not true. The issue of the tree size came to light when I visited the store to buy additional items and happened to notice a much smaller tree. I did not have a conversation at that time with anyone on the size of the tree. It was during a subsequent phone call with one of his employees that I inquired if the smaller tree was my replacement. He told me "yes" and this is when I told him I would rather have a store credit as the replacement tree was much smaller than the one I purchased.
"...after the first few phone calls from me, he realized that he would be unable to satisfy me, which he explained to me in no uncertain terms."
Again, this statement puzzles me as Kelly has not spoken to me. This is simply a lie.
"...contributing factors could be, but not limited to; weather, care and maintenance, soil, etc...these are some of the reason why we cannot guarantee our plants..."
He even went on to suggest the reason that the tree died was because of last year's earthquake and hurricane. Plausible, but not factual as the tree survived these two events along with the other $4000 in new landscaping I had installed by Ed's Plant Word. I did not notice the tree died until this past spring when it did not bloom with the rest of the landscaping. Kelly also pointed out that at the bottom of his invoice it states that they do not guarantee any of their plants... If this were the case, why did Mr. McConkey offer to replace the tree or refund my money and not immediately point me to his "policy?"
