Make a sale of property and make sure the title is clear for the property, but secondly to make sure both Buyer/Mortgage company and Seller are getting their funds. Imagine, you close on a Friday morning and you are supposedly handing over keys ? All of our plans for the future were delayed. We lost THOUSANDS OF DOLLARS in the transaction and MANY MORE THOUSANDS OF DOLLARS because of delays and lost funds. We lost AN ENTIRE tow vehicle for towing our Airstream due to the delay and the THOUSANDS that were lost because of the delay. WHO WANTS TO HAVE TO SUE THE TITLE COMPANY AFTER A SALE? It took me two days of calling 3 times a day to even get a copy of the title insurance. This caused us great consternation, save for the fact that we did buy title insurance. After seeking legal counsel, we filed a claim with the title insurance company and then notified Bluegrass about it. Their response: " We are aware a Foreclosure action was filed after the closing, before receiving; the mortgage has been paid in full and has been acknowledged by the Foreclosure attorney. There has been no cloud of title, and title is now clear for conveyance or encumbrance." Had they just been upfront about the whole situation upfront, it would have saved us time, money and distress.
