Maybe employees could not smoke by the door where customers eat!!! I do not smoke nor do I want to breathe it in while eating. Truly disgusted by my experience. New Mexico's statewide smoking ban that prohibits smoking in all enclosed workplaces as well as bars and restaurants went into effect on June 15, 2007. It also has the largest statewide "perimeter ban" which states that prohibited areas also include a ban on smoking within 50 feet of entrances. The law is commonly known as the Dee Johnson Clean Indoor Air Act. There are a number of exemptions built into the law. Localities are free to enact and enforce more stringent smoking prohibitions assuming state minimums are met. The actual New Mexico smoking law is found in the New Mexico Statutes Chapter 24 Article 16. Signage requirements are found in 24-16-15. They are as follows: "A. To advise persons of the existence of smokefree areas or smoking-permitted areas, signs shall be posted as follows: (1) for each indoor workplace or indoor public place where smoking is prohibited pursuant to the Dee Johnson Clean Indoor Air Act, a "NO SMOKING" sign shall be posted where it is clear, conspicuous and easily legible at each public entrance. Posting of "NO SMOKING" signs is the responsibility of the owner, operator, manager or other person having control of the indoor workplace or indoor public place; and (2) for each indoor workplace or indoor public place where smoking is permitted pursuant to the Dee Johnson Clean Indoor Air Act, a "SMOKING PERMITTED" sign shall be posted where it is clear, conspicuous and easily legible at each public entrance, unless an owner, operator or manager chooses to prohibit smoking in all or part of an indoor workplace or indoor public place where smoking is otherwise permitted. B. Nothing in the Dee Johnson Clean Indoor Air Act shall be construed so as to require the posting of signs at a residence, except during the hours of business operation while it is being used commercially to provide child care, adult care or healthcare or any combination of those activities. History: Laws 2007, ch. 20, § 7" As can be seen above designated smoking or no smoking areas need clear signage denoting the area. I love this place. It is, in my opinion, the best place to eat in Cloudcroft. The food is great, the service is great, and the aesthetics are great. And talk about gorgeous employees. Everyone who works there is an easy 10. I mean there's the blond cook but he's a 9 at the worst. But enough talk about the unimportant stuff. The burgers here are incredible. The entire restaurant has a very nice, homey feel, and much of the menu is named after friends of the owner and other happy customers. There's a surprisingly varied menu, with everything you could think of, ranging from fresh jalepeños to peanut butter (sounds weird, no? But believe it or not, it's not bad!). I don't think I could see any reason to change anything on the menu, save the tuna salad sandwich, I must say, wasn't my favourite. This restaurant is quite fantastic. I kid you not the worst dining experience I've ever had. We were served by the manager, who was extremely disrespectful. Not just to us but to other people as well. The place was out of several items, and rushed everyone to order. The manager made multiple rude remarks to my mom and girlfriend, and when confronted, refused to admit he did anything wrong or even apologize. Will NEVER recommend this place to anyone, and absolutely will never go back. The owner should be ashamed of his manager. read more
