Today , after no reply, I told him we would have to go to small claims. Now, he replied. He said if I broke it, it was my problem. The fob is defective. I got 2 keys cut and programmed for $50 less than my wife was quoted for 1 (she was cold-calling using Google Maps(Yelp FTW)). He knows his stuff and there was little wasted motion. He programmed the two keys separately (didn't clone one onto the other) so a third key can be made easily. He threw in the test-key so I have a third key that (only) opens the door.
