On the evening of 12/12/17, my work colleagues and I visited the establishment and one person asked for a particular brand of beer. The bartender advised they don't have it. So in jest my friend said "oh man you don't have it?" The bartender girl snapped. She replied "no we don't carry it but you can go to another bar nearby if it's really a problem." Ok whoa....she needed to calm down. Smart bartenders would simply refer a different or similar beer brand but not this one. She went straight for "go somewhere else." Not knowing who we were, I noticed the bar charges a $1 service charge for every $10 charged to any credit card you use to pay. Unfortunately the bartenders didn't know we were all state auditors. All patrons must know that this kind of service fee is against the law and is now enforced by the Texas Attorney General. Formerly this unauthorized charge and law was enforced by the Texas Office of Consumer Credit Commissioner. Being that the conversation went hostile after one bartender was already inviting one of us to leave (see above), I asked the bartender if they actually charged the $1 credit card service charge for every $10 [charged on a credit card] to customers. That's when the other bartender chimes in after listening to the entire conversation. The second bartender said "yes we charge it, everyone around here charges it. Are you going to order something or not?" Fact is, of the 5 other establishments visited in the immediate area within walking distance, not one establishment charged a credit card service fee. After two bartenders expressed they were obviously in a bad mood, the 6 of us all decided to leave. I certainly took a picture of the posted signage advising of the credit card surcharge and will forward it to the Texas Attorney General. Please be advised, if you have visited the Thirsty Monkey after Sept 01, 2017, you may file a compliant with the Attorney General if you were charged a credit card surcharge of any amount - https://www.texasattorneygeneral.gov/cpd/credit-cards . Simply follow the links and file. If you have your receipt, the state office can help you obtain the refunds for your unauthorized surcharge.
