I initially declined representation; however, the firm continued to follow up and applied pressure to retain my business, including reducing the quoted filing fee. I ultimately agreed to proceed. I made several monthly payments. After changing banks, I unintentionally missed a small number of automatic debits due to failing to update my payment information. During that period, the firm sent emails and made phone calls checking on the status of my account. Once my payment information was corrected, I eventually made the decision not to proceed with filing bankruptcy, accept my debt, and pay on my own. The firm's written agreement states that a refund may be issued if a client elects not to move forward. What is not clearly disclosed is that all communications and administrative activity--including the purportedly free initial consultation--are later classified as billable. As a result, the firm asserted that all funds I had paid were consumed by fees, leaving no refund available. The engagement agreement does not clearly define what constitutes billable work or when billing begins, which I find materially misleading. After I communicated my decision to discontinue services, the firm continued attempting to retain my business rather than promptly honoring my request to terminate representation. Recommendation: Prospective clients should carefully review and seek clarification--preferably in writing--regarding what this firm considers billable activity and when charges commence. The only good part about his firm is that his paralegal is organized and does most of the work for him. However, John is not a good lawyer and is not even decent in the court room speaking or representing clients. I was pretty shocked because I assumed he would at least appear experienced at some points during my trial. I am not writing this to attack him or his firm, but he charges a lot and I don't want others to waste their money. I spent around 15k and got nowhere with him due to his inability to convince and stay organized in front of the judge. Hopefully by writing this, Mr. Gaertner does not respond or attack me, as I understand that he was disciplined by the State Bar for unprofessional conduct. OMG Such a huge mistake!!…read more Whatever Nestrelda has stated is so true each and every word. I wish I would have read this before I put myself through that torture. I cannot believe since his first review in 2011 he is still same or I should say worse. We hired him for Negotiation deal with HOA instead of just sending a letter to HOA, as he claimed to be giving us a Discounted Deal and charged us 5 times more than just sending a letter. He claimed to be an expert and get us a WIN as this was a open and shut pretty easy case of HOA negligence but we LOST and the only reason was hiring an incompetent lawyer Mr. Mike ( Just Talk No Results) so we not only lost the case which he should be counting on his second hand (as he boost about how many cases he lost - which is exactly the amount of cases he has taken) but also our money and additional stuff he made us do to help HOA without our consent sent out email. As soon as HOA responded to 1st email he backed off and did not do no negotiation so we paid 5 times price because Mike cannot negotiate. And now he wanted us to file a lawsuit and this time he changed price 80 times more than initially quoted price ( I guess that's a discount too so he can sleep) And when we pressured him to follow through with negotiation agreement not only did he had a melt down on phone and asked us not to talk to him for rest of day but did worst job of mishandling our priorities ( making us lose what more can I say). He was tough on us but meek with HOA and it reached to a point where it felt like I paid him to yell at me on phone and stop asking HOA to do their job !!! His email was not only weak but lacked any legal content or research he was supposed to do before sending the letter. Do not get carried away by the number of cases he claims he has taken or how much ever discount he offers you, HE WILL NOT BE ON YOUR SIDE - as he is a weak and incompetent lawyer. All he is good at is filing paperwork for businesses , no people skills am not even sure if he gets to deal with people or cases on regular basis.
