In my opinion, based on the documents and communications involved in Tyson v. Correa, serious concerns arose regarding the professional handling of escrow by Olivia Mercer during a real-estate transaction that ultimately did not lawfully close. From my perspective, escrow proceeded in a manner that did not adequately address fundamental issues affecting the validity of the transaction. Throughout the process, escrow communications and document processing continued despite unresolved questions regarding legal authority. The individual induced to sign transaction documents was not the lawful trustee and did not have verified authority to sell or convey the property. In my view, this was a material issue that warranted suspension of escrow activity until clarified. Instead, the transaction appeared to continue as though it were routine, despite these unresolved inconsistencies. There were multiple warning signs that, in my opinion, should have prompted escalation or a pause in escrow, including conflicting trustee information, inconsistent instructions, and communications that treated a known tenant as if they had authority to act on behalf of a trust. Based on my review of the records, these issues were not clearly resolved before escrow activity proceeded further. It is my understanding that escrow officers are expected to act as neutral parties and to refrain from facilitating transactions when documents are facially inconsistent or legally unclear. In this situation, I believe escrow should have required verification, clarification, or withdrawal rather than continuing forward under uncertainty. Allowing the process to proceed under these circumstances, in my opinion, exposed all parties to unnecessary legal and financial risk. I am sharing this experience to encourage buyers and sellers to protect themselves. Do not assume that escrow, title, or agents have independently verified authority simply because documents are circulating or deadlines are approaching. Independently confirm ownership, trustee authority, and escrow instructions, particularly in trust-related transactions. If anything does not make sense, stop the process and seek independent advice. This review is offered as a cautionary perspective so others understand the importance of due diligence and active oversight in real-estate transactions.

They are…read moresupposed to act in a neutral manner but interfered with the process for an estate matter and tried forcing us to take a check for the proceeds -- would have taken a month to clear. They claimed it was office policy but they revealed to our broker that they were concerned -- a concern that is not theirs to bear. By inserting themselves into the concern, they expose themselves to personal liability, in the event the transaction fails or excess fees are incurred, such as attorney's fees to get them back on track. Also our escrow officer suggested in an email on July 12, 2021, that she could alter a notarized document.

I called in to them this morning to confirm information so we could send a large wire to them. I…read morespoke to Esther and just have to say she was very disrespectful on so many levels. There is a lot of fraud out there, so I completely understand being safe and asking for information before confirming information. I had all the instructions and was just asking for her to verify. I told her the name of the real estate agent we were sending the wire for, and she instantly became very angry and raised her voice and replied; "she already called me this morning and I told her we do NOT have the revised wire amount ready for her yet, and now she has you calling us?!" I replied that the realtor had literally just given us the updated wire amount, moments before; and I provided that new number to Esther. Esther then placed me on hold without telling me - and I was about to hang up when she came back on the line and told me that I had the correct "revised" wire amount. I had one more thing to clarify, as their wire instructions are 3 pages (I have never seen them this long) and they separate the Escrow Company, and then list another completely separate block of information titled "BENEFICIARY BANK" as though they are separate items. I just asked and wanted to be sure there wasn't an intermediary bank (as there often is). I had one account number and one ABA number, but wanted to be 100% sure that they went together with how the directions were spaced out - and separated - it did not look like they were the same party. She said; "I can't give you information, you need to call the realtor." I had given her all the numbers, and she just got stuck on being sure to make me call the realtor (that I could tell she was already angry at). We had no choice as we had less than 2 hours to get the wire processed. .. And the realtor was of course, not happy that we had to call her and she said that the wire details were included in the instructions she provided to us. The realtor advised that Bank of America had just transmitted with those exact instructions and it went through without a problem. Hearing that helped me determine there was no intermediary bank. It's just so sad that she simply refused to just tell me that. My ONLY goal was to not make any mistakes on an extremely large wire. There were so many people it would have affected if I had not done things correctly. We need to be kind and grateful that we have people being careful for MUTUAL clients that we serve. I really do not understand why people take things personally and are so unkind and unprofessional. I can see this company has great reviews, so this might be a bad apple. In the end our wire went through properly.
