After doing some research, I have found and I quote, " Texas law prohibits debit‑card surcharges Texas Business & Commerce Code 604A bans a business from adding a fee because you used a debit card." Visa, Mastercard, and Discover all prohibit surcharges on any debit transaction -- even if the restaurant runs it as "credit." So even if Texas didn't ban it, the restaurant would still be violating its merchant agreement. In summary using a credit card and being charged a service fee is one thing but as you can see using a debit card i a different avenue.
