Mary, as president and one of the owners of Rodemyer-Christel, Inc. (RCI), I feel I must respond to your review of my company on Yelp as your comments are inaccurate and slanderous of my firm. RCI does not have the authority to make the decisions for the Condominium Association where you live and own a unit. RCI, as managing agent, is the liaison between your Associations' elected Board of Managers and the vendors that are hired on behalf of the Condominium Association. In your review you state, "The Company only has a couple hundred dollars left in reserves." This is completely false. Your Association at the time had very limited funds in its Operating Account. Please remember that RCI and the Crossings at Hickory Sound Condominium Association are two completely separate entities and the funds needed to operate your Association come directly from the homeowners of your Association and not from Rodemyer-Christel, Inc. Again, Rodemyer-Christel, Inc. makes NO decisions on how your Association's funds are spent as these decisions are always made by your association's elected Board of Managers. Our property manager assigned to your Association has tried explaining this to you multiple times but you have been unwilling to have a rational conversation with her and have hung up on her multiple times she has called to discuss your concerns.
You also reference that the Board decided not to allow the members to vote on an assessment for the work that was urgently necessary to complete due to potential health hazards related to the mold. According to the governing documents for your Association, the Board of Managers has the authority to levy a special assessment as needed. The meeting was called to discuss and inform all the members of the Association on the situation with this particular unit. Unfortunately this particular unit owner had abandoned his unit, which meant that the Association had no choice but to take on the cost to remediate the mold to prevent it from spreading to the other three adjoining units in the building. In your Yelp review you state, "Company, instead of criminally or civilly going after this owner, decides to make EVERY other resident in Condo. Building responsible to pay $1000+ to make up for his negligence." Again, this is not factual. The Board voted to approve an assessment of $980 per unit owner to cover the cost of remediating the mold in the unit, and to replenish the operating and reserve accounts. Your Association does not have the ability to file criminal charges against the unit owner that neglected his unit. However, the Board is taking legal action and is filing a lawsuit against the owner to try to recoup the costs (including legal fees) that were paid to resolve this issue. There has been some discussion by Association members about returning all or a portion of the $980 special assessment if the Association is able to recoup sufficient funds from this particular owner. These decisions will be made by the Board of Managers at the time.
You also state, "And now they're asking everyone to pony up $1000 (under the tiny printed word "special assessment") because Rodemyer-Christel, Inc. has been so inept with their reserve money." The letter that was mailed to all owners regarding the special assessment was typed in 12 point font, including the words "special assessment." Once again, your remarks are completely inaccurate. In addition, Rodemyer-Christel, Inc. has absolutely no access to the Your Association's reserve account. The Association controls their reserve account, so your statement is completely false.
Finally, the Association hired their attorney (it was not an attorney hired by RCI, nor does the attorney work for RCI) to send you a letter because you have refused to pay the special assessment. As a homeowner in the Condominium Association, it is your responsibility to pay the assessment that was levied by the Board of Managers. Again, this is outlined in the governing documents of your Condominium Association. I urge to read the Bylaws and Declarations for your Association so that you will better understand how your Condominium Association operates.
As the President of Rodemyer-Christel, Inc., I would be more than happy to discuss the governing documents or the operation of your Condominium Association with you at any time as would your Association's Board of Managers.
