BEWARE OF COMPANY HONORING THEIR BUSINESS CONTRACTS AND AGREEMENTS
If a business does not respect themselves to keep their agreement on price, for what ever reason, that is called a breach of trust and not an entity to have business with. Hopefully, the owner reads this and perhaps will tell me he misunderstood and the salesman misspoke.
Facts:
a. Quickest and cheapest in proposing for the roof project for home and garage.
b. Observed a job being done by a crew speaking russian and spanish, managed by a very knowledgeable and professional lead, Rory, who explained patiently on the GAF roofing system. That made me request him and his team specifically.
c. After a bid process, I chose them and they were going to schedule the work within a week. Salesman sent electronic contract to sign, that he as a representative of American Quality Remodeling Inc from Burlington signed. It did not have the picture of the house, garage or state the GAF accessory's necessary for the GAF Gold Pledge (which they also did not explicitly write). So I provided comments and asked to be sent the amended contract to sign. Probably the first client that does such a due diligence and actually reads. I also received a request for 30% deposit to immediately pay.
d. I immediately reviewed and sent my comments. After sending 2 emails and text messages to salesman, and then leaving a message with "receiptionist" Lee. He inquired what my issue was and asked if I would send them a copy of the contract. That raised the red flag on who is authorized to sign a contract and bind the company and wouldn't they have a copy??? He then clarified that they are all full time employees of the company.
e. After 10 min of speaking with Lee, the Saleman calls and says they made a mistake on the measurement of my house and garage and therefore will not honor their contractual agreement. He suggested to increase the price by close to 25%.
f. He commented that "Rory" would have caught the mistake after I signed the contract and gave them my cash deposit.
To the owner and Rory:
I had a contractual agreement with a price, what it covers and content. The comments I provided to the contract, were to be explicit that its a GAF golden pledge that included (not just any "gold pledge") and all the accessories GAF requires in order to register and provide their GAF "gold pledge". If all the accessories are not used then they would not be able to register the project with GAF for the warranty. The warranty is not purchased, but rather registered when using a certain group of the GAF products.
It takes a lot of audacity to come back to a customer on this "mistake".
I asked the salesman to talk to you and ask that you keep your word and price.
