    I represented myself as the plaintiff in an arbitration case against Comcast. Comcast was…read morerepresented by 3 attorneys from Davis Wright Tremaine out of Washington, DC. Pat Curran was the lead attorney with two other attorneys on his team. I was forced to file a complaint when Comcast deleted my Internet account of 27 years without my request, knowledge or consent. The account contained 27 years worth of emails, contacts, receipts and more. The account email address had also been used to log into over 600 online accounts for myself and my clients. In an instant 27 years was gone and I now needed to figure out how to access what remained.. It took over 2 years of litigation before I learned that the account was deleted due to a software glitch. Comcast admitted early in our proceedings, in writing, that they had made a mistake, without actually acknowledging how the mistake was made. Mr. Curran and his team defended Comcast's actions "mistake" none the less. Their only defense was the exculpatory clause contained in all Comcast subscriber agreements. That clause basically states that no matter what might happen to you or your assets as a result of subscribing to their services, Comcast is not liable ... for anything. In the course of our 2 plus years of mandatory arbitration, Mr. Curran committed numerous violations of professional conduct, including but not limited to; 1) withholding information, 2) making numerous false statements, 3) filing a dispositive motion to vacate using false statements and the wrong applicable state law, 4) making repeated discovery requests that were not only overly burdensome, but irrelevant to the case 5) refusing to go to mediation, in violation of the scheduling order and 6) acting in a discourteous, disrespectful and uncivil manner. Mr. Adam Caldwell, Mr. Curran's team member once wrote to me stating, "I understand you don't like to not get your way, but that's how this works." I did in fact get my way ... I won the case. At the hearing itself, Mr. Curran lost his temper. After the hearing he called to ask if I would be willing to "settle" for 50% of the award in exchange for his not appealing the case to district court. I laughed. He hung up the phone. I am fortunate to be a resident of the State of Colorado, where there is a Supreme Court Ruling which states, "respondent's claim that their subscriber agreement insulates them from culpability is invalid." This information was presented to Comcast's legal team in advance of the hearing, yet they still elected to proceed with a hearing. The claim they lost was that of their breach of the duty of good faith and fair dealing. Why would anyone want to do business with a company that treats their customers like this, especially a customer of 27 years.
