I invested with this group in the company's mortgage pool called the Foundation Fund. The company sold the investment based on transparency and that they were different from other trust deed investment companies because they had a team of real estate professionals that looked at every deal and performed licensed appraisals on every loan that they sold to investors.
As evidenced by their website:

Because of transparency promised through their website and communication from the company, specifically from Senior management, I invested with them.
Once I did, the entire process changed. As soon as I began to ask questions about the loans being invested in the fund, and asked for what I thought were reasonable documents relative to my investment like for example, the so-called appraisals that were supposed to be performed on the loans, I could never get an answer from them or at best documents from them. In fact I never got return phone calls despite the fact that I made several calls to the office and each and every time, I was told that someone would call me back. That never happened.
I then began to research the company and found out that the company was involved in significant litigation. I did a search in Santa Cruz, CA for lawsuits and you can research the lawsuits as well:

Just simply type in the name Sterling Pacific Lending Inc and you will see the lawsuits filed against the company.
I then decided to contact the company once again to ask questions, giving them the benefit of the doubt. Their nonresponsive approach did not change, however this time they had their attorney contact me with a threatening letter demanding that If I continued along the lines of questioning that I should "immediately seek legal counsel" to represent myself.
I am almost 80 years of age, and am not a sophisticated investor. The question I still ask myself is that if this company was so transparent as they initially had claimed to be, why would they not have disclosed this litigation when asked about it and why when I asked them about it, would they choose to not answer the questions or simply return phone calls.... but rather have an attorney send a threatening letter to me telling me to "immediately seek legal counsel". That is not a response I would expect out of company that prides itself on transparency and customer service.
Everyone understands that markets suffer downturns and businesses sometimes have to deal with lawsuits, but 15 lawsuits in the county they do business in and more than 5 in other counties demands some sort of explanation for a company that claims to be transparent.
I have tried to get an answer but can not. I have tried to get my investment back, but have not been successful. This leaves me in a position to decide whether or not to pursue legal action against the company to gain some sort of transparency.
I am not seeking a forum to voice my individual issues with the company but rather to rate the company on service and to provide relative feedback to the service given by the company. My hope is that it will allow others to at least consider looking into the company before investing.
A company that believes in transparency will have not problem providing it. I wish the company had been transparent with me when I invested. read more
