In response to Brendan O's Review on 7/13/16: I came across this review today which contains insults and untruthful information. I was to be the seller in this transaction. I never met Brendan O and I'm sure if we did meet he would not think I was a weasel. I suspect if he met Joel and his team he would think differently also. As Brendan mentions he signed the Seller Disclosure Form where I identified that the neighbor's fence encroached on my former property. I provided a survey which clearly showed the issue. If there was an issue obtaining the survey the seller or his realtor could have found it on the Kootenai County website as it is a matter of public record. While I understand this type of dispute is unwanted, it was disclosed and further this was a case of 'what you see is what you get'. In other words the property that the buyer saw on my side of the fence was his regardless. Nonetheless several resolutions were offered including to reduce the sales price by $10,000 on a $300,000 transaction for a 6'x110' piece of land. I asked for more earnest money than usual ($5,000 I think) and held it as long as I could because I was losing vacation rental income during this transaction. Despite potential for negative reaction such as this, the Joel Pearl Group supported me in holding the earnest money as they had the best interest of their client in mind. When the seller produced written documentation from their lender or title company (I can't remember which) saying they could not proceed with the transaction, the earnest money was returned without delay. I am a civil engineer that has been involved in many land issues over the last 18 years. I have seen a lot of realtors come and go as the market does and witnessed the incompetence of many. It seems to me that there is a substantial percentage that only cares about the commission. Joel has built his business and retained it through the recession because he is educated, intelligent, connected, and sees that the long-term interest of his clients is more important than any one transaction. Maybe This buying transaction was colored by the wonderful relationship we had with the sellers agent we had at the other end of our transaction. Robin Bundy, with Joel Pearl, did not seem to take ANY extra steps to make this transaction smooth. The icing on the cake here was that at our final walk-through, the day we were to sign the papers, we were told that some work to be performed by the inspection service was not going to be done. This, in essence, had nothing to do with the seller of the home, and we went ahead with the deal. I will try to be concise. We were long distance from here while this transaction was progressing. Robin arranged for a home inspection with someone he thought was reliable, as we were unfamiliar with this area. After receiving the report, we found significant porch/roof damage in pictures that we had taken that the inspection missed. When Robin asked him about it he said he would fix it for us himself. That contract offer on the house was cancelled because our house was not selling. Subsequently when we had a new solid offer on our home we opened a new contract on the same home in St Maries. We were assured by Robin that inspector would take care of repairs. We had to push hard to get that in writing from Robin and the inspector. On the day of the walk-through, when we met at the house, Robin tells us that inspector will not touch the repairs. Apparently his insurance company told him not to do it because he wasn't liable because it was a previous contract. I am not knowledgeable in this, but it seems to me that both the inspection service and the realtors should have been conscious of this fact. We could probably Perdue this in court, but that is not our thing. The realtor's resolution to us was to refund the inspection fee. This will probably cover a fraction of the cost of repairs. At the other end of our transaction, our realtor covered half of the termite work required by the VA loan the seller was getting. read more

I have bought and sold many properties in my life but have never been involved in one as horrible as the one that I just walked from (after 40 days of lies saying they would fix the fence in escrow before close) with Joel Pearl as the listing broker and Jeff Kreis as the minion he had represent the property. The seller Eric Olson is just as big of a weasel as these guys but I can't review him. I went in with a clean full price offer with no contingencies expecting a quick easy transaction as I have always had in the past. This was far from it. It started the day that I signed the RE-25 Seller Disclosure Form when I saw that there was an issue in the vague comments about the neighbor's fence encroaching on the property. I asked my agent to get the full detail of what these comments mean (by how much, past neighbor dispute, etc...). This went on for a week with Joel Pearl's office trying to brush off the request. Finally Becky Stafford the admin sends an email to my agent saying the seller will turn over the survey and details of the encroachment after the property closes. We immediately went back and said that is a weird response and we want to details of the encroachment now, so we can have full disclosure. Many red flags are popping up at this point, and my agent and I are thinking this may be a big issue. The reluctance to produce all the info shows that they thought they could get away with partial disclosure (illegal by the way) knowing any buyer would not be interested in getting involved in a property line dispute (WHEN THE FENCE IS 100+ FEET LONG, FULLY LANDSCAPED ON THE NEIGHBOR SIDE, AND SITTING 6 FEET ON MY PROPERTY. THAT IS WHAT THEY WERE HIDING BECAUSE THEY KNEW IT WOULD BE A DEAL BREAKER FOR 99.9% OF ANY POTENTIAL BUYERS). Partial disclosure is equal to non-disclosure and even worse in my book because it is intent to deceive. They knew full well what they were doing by their actions, the seller having done a property survey years earlier, and their attempt to sweep the problem under the rug so they could close the sale and move on leaving the unknowing buyer with a neighbor dispute to right the wrong and all the hassle that comes along with it. STAY FAR AWAY FROM THESE UNSCRUPULOUS SHYSTERS (JOEL PEARL AND HIS TEAM OF MINIONS) REPRESENTING YOU IN ANY TRANSACTION. IF YOU HAPPEN TO HAVE THE MISFORTUNE OF WANTING A PROPERTY THEY LIST, TAKE COMPLETE CAUTION, DO YOUR DUE DILIGENCE AND BEFORE SIGNING ANYTHING MAKE THEM FULLY DISCLOSE ANY POTENTIAL ISSUES SO YOU CAN BE COMPLETELY INFORMED TO MAKE DECISIONS AND NOT EXPERIENCE WHAT I DID.
