Paws up splits up the employee pay this way to keep from having to pay overtime. Then, they refuse to hire enough employees and force current employees to work overtime to cover the shift shortages. Employees earn less in overtime than they do in their regular hours. The majority being called "seasonal" employees with no health insurance, benefits and now the resort has gone "gratuity" free refusing to let employees take tips even when they go above and beyond in making a guest's stay wonderful. This has cost some of the employees over $1,200 a month in income. Paws up tries to say they increased the bonus portion of the pay to try and make up for that loss but keep reading, you'll see how that's illegal too.
There are a bunch of other sections on the labor laws you can read through on tipping, regular pay, etc. that will show how the Paws Up pay system, collection of money from guests to use towards their employee's bonus pay is illegal. They admit on their website in fine print that they charge guests more for housing to make up for going "gratuity free" or no tipping to the employees. That additional charge to guests for housing to use as part of the employee's bonus pay- that's illegal too. It's in the law.
If what they were doing all across the board were legal, every employer in America would be doing it. Others don't because it's illegal. The Dept. of Wage and Labor is on to them. That's why suddenly employees who Paws Up claims are not full time year round despite actually working full time year round now for YEARS have to take 2 months off unpaid. Paws Up has been claiming people are "seasonal" employees despite their working full time year round for YEARS so they didn't have to pay health insurance or benefits for them. Their PAW was slapped so they turned around and told these "seasonal employees" they had to take months off with no pay because Paws Up is too cheap to call them full time on the books and pay them health benefits. Now these employees are leaving right and left after being treated like they are worth nothing despite being dedicated employees for years and being the sole reason why guests have a wonderful stay. These "seasonal" front line employees are what make the guest's stays worth it. Now, you see how they treat the people who make the stays worth while.
More changes are coming as more agencies Paws Up accountable for unsafe work environments and illegal pay practices. Now that one of the owners (Dave Lipson) has recently died, we'll see if any of the remaining owners or people in charge will do the right thing or just shut the place down.
Here is what OSHA just did. They are still looking at Paws Up too for a bunch of other things. It looks like this fine was only for one work place- "Kia Barn". No doubt more locations to come as employees turn them in.
