In violation of 18 U.S. Code 1519, Cynthia, the office manager, knowingly altered, concealed, covered up, falsified, and made a false entry in official government and medical records, documents, and tangible objects with the intent to impede, obstruct, and influence the investigation or proper administration of this matter within the jurisdiction of any department or agency of the United States (including the Department of Justice), in relation to and contemplation of this matter. Also, in violation of 18 U.S. Code 1512, Dr. Bradley Frasier, on a followup call, knowingly used intimidation, threatened, and corruptly persuaded the Plaintiff(attempted to do so), and engaged in misleading conduct toward Plaintiff, with intent to influence, delay, or prevent the testimony of Plaintiff in an official proceeding.
Medical malpractice is a legal cause of action that occurs when a medical or health care professional, through a negligent act or omission, deviates from standards in their profession, thereby causing injury to a patient. The negligence might arise from errors in diagnosis, treatment, aftercare or health management.
1. A doctor-patient relationship existed.
2. The doctor and staff were negligent (medical fraud).
3. The doctor's/staff's negligence caused injury and pain.
4. This led to specific further damages.
San Diego Imaging was appalled that (1) North Coast Urology did not request an ultra sound at North Coast Urology, (2) Cynthia would attack a patient for not knowing what the term she had used to describe his medical condition (and berated him non-stop in different forms on a recorded call while enjoying the unwarranted harassment to patient), and (3) that the diagnosis was incorrect from the doctor. This will be further filed with the State Medical Board for immediate disciplinary action and has already been filed with his insurance carrier. San Diego Imaging staff (two) immediate reactions were "Oh My God!" (while gasping) and "I can't believe she said that to you." Fortunately, Cynthia and Dr. Frasier conversations were recorded and will be used against them in government proceedings. It is a shame that Dr. Frasier was aware of Cynthia's unprofessional conduct (see other reviews) yet did not fire or discipline Cynthia. He rather condoned her actions than cordoned them even though he stated that it was inappropriate for her having acted unlawfully and inappropriately in the manner that she had.
Another doctor of the office did not request an ultrasound and incorrectly diagnosed his condition. Dr. Frasier questioned Plaintiff as to why he circumvented their diagnosis and got a second opinion which required Plaintiff to get an ultrasound on a recorded call. Plaintiff had to request it himself on advice from Urology Center. In addition to all of this, staff refused to provide Urology Center with the ultrasound lab test results, although they were instructed to do so by law. Plaintiff contacted Oceanside police who agreed with plaintiff after hearing the recordings that Cynthia was out of place, unlawful (in violation of OSH Act), unprofessional, and engaged in professional misconduct with the deliberate intent to maximize the harm to the patient physically, emotionally and illegally in an official report (in retaliation).
In addition, Plaintiff had called North Coast Urology to inform that that he was in excruciating pain and never received a callback.
The diagnosis was incorrect (malpractice), staff were abusively unprofessional (see low rating reviews), failed to train staff, and discipline staff for rude, unlawful, and unprofessional behavior.
Dr. Frasier was aware of Cynthia's unlawful behavior in other comments on this site and allowed future patients to go thru unwarranted harassment by Cynthia.
