Instead, he abandoned the job during my pregnancy and shortly after we had paid him more than $19,000, leaving unfinished work and subcontractor issues that needed correction. He informed our insurance company that the project was 98% complete, even though work remained unfinished and some work required correction. He later filed a civil lawsuit against us seeking payment that we dispute, including amounts we maintain had already been paid, mitigation payment, and amounts for work that was not completed. Before he abandoned the job, at his direction, we met his wife, Carmen Fimbres, at their bank to deposit a check payment. The check was processed, and we have documentation of that payment. The amount is nevertheless included in the money he is seeking from us. Communication was also difficult. He expected his calls to be answered immediately. On more than one occasion, after I returned his call, he spoke to me in a harsh, raised tone and said, "Do you have a problem with me?!" We are now dealing with the stress of an unfinished project and a lawsuit over money we believe was already paid. Because I have contractual obligations to my client and could not obtain a clear timeline for the project, I decided to cancel the work and hire another contractor. After I canceled, I was informed that I would be charged an additional $380 for a second visit and a cancellation fee. These charges were never disclosed to me beforehand, and I was not provided with any written agreement explaining cancellation fees or additional service charges beyond the original visit fee. My experience was frustrating because of the lack of communication, the absence of a clear project schedule, and the unexpected charges that appeared only after I decided to cancel.
