On August 21st, 2017 Jason Taft - General Contractor and Representative of Benchmark Building & Development, Inc. executed an agreed upon contract for the scoop of work with a base bid of $76,685.77
The scoop of work included demo, materials, millwork, railing, floor, framing, trades, drywall, paint, finishes, final trades, punch list, final inspections. The total scoop of work was to convert a pre-existing restaurant into a Sus Hi Eatstation restaurant.
Initial Payment of $16,068.58 was process upon execution of the contract.
2nd Payment of $31,574.31 was processed upon receiving permit approval which was approved by the city on 12/19/2017.
The project was scheduled to be completed 45 days after receiving the permit. Schedule to be complete on March 6th, 2018
Throughout the initial first half of the phase of the project, Jason Taft communicated the work he was able to complete and was able to complete the demo, materials, millwork, railing, floor, framing, trades, drywall, paint.
Our Management division communicated with Jason Taft 3-4 times a week via phone call, text, and e-mail. Upon late March when the project became more than 30 days past due, Jason began to reduce communications and cease to respond with adequate updates on the timeline.
The third installment of $19,042.88 was paid on March 16th, 2018 which included final drywall, paint, finishes, and final trades.
After receiving the third installment, Jason shifted his communications to pointing blame at other factors - including but not limited to - weather, bids too expensive, unprofessional conduct, contractors disagreements, work order changes, etc.
On April 24th, 2018 I reached out to Jason to communicate that we will be seeking legal action for not delivering the commercial space as per the contract.
Every week till the end of July our Management company communicated to Jason Taft demanding updates with no reply, or excuses of "gathering bids" or "working on it".
We sought legal counsel in July and sent Jason Taft certified mail with damage demands. As of August 2018, Jason Taft resigned from the project and did not fulfill his contractual agreement.
Jason Taft of Benchmark Building and Development, Inc. has received funds for work that he has not completed by contractual agreement.
We are formally submitting a complaint to the Better Business Bureau and the Department of Business & Professional Regulation that Jason Taft of Benchmark Building and Development, Inc. has not completed his contractual agreement and has walked away with our funds.
It is now September 18th, 2018. 9 months and 12 days from the Execution of our Contractual Agreement 192 days past the deadline for completion of the said agreement.
Upon discussing with our attorneys, Jason Taft was sued in 2012 for failure to complete a contractual agreement for a commercial restaurant space and lost.

We are seeking refund and damages of all work incomplete by Jason Taft of Benchmark Building & Development, Inc.
Damages include $43,400 for late damages for the inability to deliver the completion of the project for a total of 192 days past due.
Damages also include a refund for all invoiced and paid work that was not completed from Installment #3 paid on 3/16/2018 for $19,042.88.
Total estimated damages are $43,400 as of Sept 18th, 2018. Not including loss of revenues, excess labor costs, and other costs associated with not delivering a commercial space on time.
Do not hire Jason Taft or Benchmark Building Group.
