The Facts:
On April 10, 2012, we signed a contract for hardwood floor installation in the amount of $5468. The contract stated that the work would be completed in 2-3 weeks, and we authorized our Discover card to be charged $2768 as a deposit. The follow day our Discover card was indeed charged. On April 25, our Discover card was charged an additional $2500 despite the fact that we had not heard a word from Arcade Floors regarding our hardwood floor installation and not one bit of work had been completed (according to the Maryland Home Improvement Commission, this is illegal). May 1st was the latest date at which the job should have been completed according to our contract; however, we still had not heard from Arcade Floors. Therefore, on May 5th, we called, explaining that we had not heard from Arcade Floors despite the fact that the work was supposed to be finished. A message was taken, and the employee stated that we would receive a call first thing on May 7, 2012. It wasn't until May 14, 11 days after the job should have already been completed, that Arcade Floors called us to schedule installation. The work was scheduled for May 29-30, four weeks after work was due to be complete according to the contract.
On May 17, 2012, Arcade Floor charged our Discover card an additional $2768 despite the fact that we had already paid the charge even though not one single floorboard had been laid. To be clear, Arcade Floors had now charged over $8000 for a job contracted for $5468. We called Arcade Floors on May 21. The company's vice president stated that she would call the following day with a resolution. She never did. We called again on May 23. The company's vice president stated "to be honest I didn't do it until yesterday morning" in regards to taking off the fraudulent charge and repeated "This isn't how we do business" and that she is "completely befuddled." The company vice president stated that the work would be completed on May 29th and May 30th and that the final total would be reduced by $500.
On June 5, 2012, the vice president of Arcade Floors told us that she had double posted the credit we were owed. Therefore, being ethical people, we authorized the company vice president to charge our Discover card $2,200, which was would add up to a newly-agreed upon discounted amount. Our credit card was immediately charged $2,200. This was supposed to end the matter.
However, on July 5, we discovered that the disputed charge had been reposted. The company vice president promised that she would take care of the matter first thing on Monday, July 9th.
From July 9 through July 26, we contacted Arcade Floors every few days. The fraudulent charge remained on our Discover bill. The company vice president stated that she didn't know what happened; and gave us many different excuses by way of explanation. Finally, on July 27, the company vice president admitted that she had indeed received an additional $2768 from Discover. She stated that she would repost a credit that day, over three weeks after we reported the error. However, the fraudulent charge remained on our Discover card. We called Arcade Floors on August 1, and the company vice president stated that she had posted the charge late on Friday. She stated that she would call right back after ensuring that the transaction was pending. The company vice president did not call back as promised, and she was gone for the day when we called at 3:30 the following day. The fraudulent charges still remain on our Discover card, over four weeks after we notified Arcade Floors of the issues, and two and a half months after the original error was made by Arcade Floors.
