Almost everything is handled by non-lawyer employees. Insurance companies know that, they make way-low offers, which are almost always taken. Two friends were injured in a classic wreck, they had the green light, middle of the intersection, a driver on his phone plowed through, hitting the Right-Side Door. Car video caught it all. One of the injuries was unusual, the passenger's hearing was dramatically affected. I called a couple retired PI lawyers I respected, described the case; after two of them suggested Marc Lenahan, I quit and called Mark. He has a reputation in the legal community of taking cases with unique injuries and pursing them vigorously. The clients were amazed: he called and talked with them for over an hour, explained how he practiced, their options to choose other counsel, talked about their damages, "If you do want to hire me, here's my address, call and make an appointment." The Insurance Company Adjuster made offers that were insulting, a couple thousand dollars, take it or leave it. Marc called, "We can reject it, file suit, that will likely get the attention of somebody above the Adjuster." Marc did. And, a couple months later called to say he'd gotten 100% of the Policy Limits. On both claims! Many PI lawyers only take "major" cases that may net them beaucoup bucks. A simple "we think we can help you or at least offer some ideas based on what we've read so far" or "we don't think we can help you based on our initial review but would like more info"... would've been preferred. Instead it felt like they could just take my money just to say "sorry, we can't help you."

We completed mediation and then, when mediation failed, they refused to file suit. All they wanted was a quick settlement, quick money so they didn't have to do much work. As a paralegal, I know that when an attorney refuses to take your case to trial it is incredibly hard to get another attorney to represent you. By taking our case, never intending to represent us through trial, they basically ensured we would not be able to find another attorney and would not be able to sue to recover our damages. To say this is unethical is an understatement. DO NOT USE THIS FIRM OR THE SAME THING MIGHT HAPPEN TO YOU.

I had been receiving treatment via my health insurance at first but my health insurance sent me a letter stating that they wanted a reimbursement for the coverage due to the injuries being related to a car accident in which I was not at fault. Once I signed with Houston M Smith, they arranged my medical care directly. They sent me to Foundations Physicians Group which was some of the worst medical care I've had. From the lack of communication and explanations of treatment. I expressed my concerns to the law office and was told that I might need to "accept the reality that I might not be the same as before the accident." Definitely not what I wanted to hear especially since all medical intervention had not been explored. After I got to a brick wall with Foundation, I decided to end treatment and close claim. I sought medical advice elsewhere and was given treatment options that I felt were better to treat my disc herniations, only con was that the Disc Seel procedure doesn't accept LOP or insurance, it's self pay only. When it came time for the law office to retrieve my medical records, it took forever. Every week or so that I would call they'd tell me they're still waiting on records. So I contacted the doctor directly who told me that there was never a request for records from my attorney. That was frustrating. Communication with my particular case worker was almost inexistent. I could hear the annoyance in her voice when I called for updates (which I wouldn't have to do if she checked in regularly). I've felt no sense of prioritization or urgency with my case. And it's a pretty straight forward case, I'm no ambulance chaser nor were my injuries that complicated. I simply wanted enough compensation to cover my disc herniation procedure and the medical bills I've accrued to this point. The person who hit me has minimal coverage that barely covers the medical expenses so it will be interesting to see how this all ends but I hope the 33% Houston M Smith get is worth it. I certainly don't think it is.
