Things happen and if he had explained that his pole broke off and that he would have to come back with tools to get it out and finish cleaning, we could have moved forward. The basis for liability under negligence stems from an individual's failures to behave with the level of care that someone of ordinary prudence would have exercised under the same circumstances. He knowingly put our home and our personal safety at risk with a smoke and fire hazard, and that is egregious. It took months to settle our claim with our credit card company and get our money back. I've had time to consider my review and to post the facts without heightened emotion. Not cleaning the fireplace well and not returning calls for assistance is enough for a bad review but purposeful negligence is grounds for not being allowed to do business in this industry.
