I am writing on behalf of Derby Street Commons in East Orange, NJ, to request your formal assistance regarding a dispute with A Cut From Above.
In April 2025, A Cut From Above was hired to resolve water drainage issues in our backyard. Despite multiple follow-ups indicating that the issue persisted, a representative named Jay did not assess the site until March 2026. At that time, he claimed the scope of work was limited to a downspout connection, stated he would issue a refund, and terminated the business relationship. To date, we have not received the promised refund of $5,200.00.
Furthermore, when we contacted the company's insurance agent, John Ortega, to file a claim, he stated that permission from A Cut From Above is required to proceed. According to NJDOBI Regulations, we believe this information is incorrect, and I will be filing a complaint against the agent as well.
Derby Street Commons is seeking your guidance on the proper steps for filing an insurance claim or securing our $5,200.00 refund.
