There was no contract - I paid with cash. The case ended up requiring a follow-up court date - since there was no contract, he charged me the same fee as the first time. He didn't obtain any of the police records. He didn't perform any background searches on my opponent. My opponent's attorney arrived prepared with these documents. When I asked him why he hadn't done any of this - he told me that he was trying to help me save money. He told me I would need to provide any such documents to him. I had to pay to have these things done on my own time and bring the documents to him for our follow-up court date. I overheard my opponent and her attorney discussing their previous meetings and expected questions. He never prepared me for any line of questioning (him or opposing counsel). Afterwards, I asked him if we could meet before the second court date and he replied 'Sure. Call my office and schedule the appointment.' I'm happy that I won - but I am unhappy with the service I received. Additionally, I regret that I went into this without a contract. Once a follow-up date was deemed necessary, I felt very vulnerable regarding what he would charge me and I was afraid to consider another attorney for the follow-up. I learned a tough lesson. She filed false accusations with Macomb Probate Court about me, saying I was stealing funds from my disabled son who has a brain injury. Richard Smutek represented me to defend against her serious accusations after the Probate court appointed an investigator to find proof against me of her allegations. The Court wanted everything going back seven years, Bank statements, receipts, registrations, etc. all documents were given by me to Richard Smutek and he presented them to the investigator. After two plus years of giving this court appointed investigator everything he wanted time and time again, all complaints/charges against me were proven to be false and dismissed by the Macomb County Probate Judge. Richard has been my personal attorney, and my business attorney since 1993. He even represented my ex-wife on a false domestic assault charge she tried to do against me. The police looked at the security video when they arrived to arrest me after SHE called them and said I was beating her. They saw she was the DRUNK AGGRESSOR in the footage who attacked me.
