I am a masonry contractor in Sarasota, I had a concrete block wall project that required a concrete cap on the top. I called White cement and spoke with the owner, he told me he had 21 pieces in stock and could make the other 33 pieces but it would take 5 weeks to make them. He told me I would have to pay for the whole order in full before he would put the order into production. So I payed him in full and picked up the 21 pieces and installed them. My crew leader informed me that the wall caps came from 2 different molds and could not be installed next to each other. I called the owner of WCS and told him of the flaw in his production and this project was on a new $6 million dollar condo, he didn't seem to care. 5 weeks went by and I called to see if the rest of my order was complete, they made only 13 of the 33 pieces to complete the order. The owner of WCS said he needed 4 more weeks to complete the order, I told him it was unacceptable as my contract had a liquidated damage clause or a $1,000 a day fine for every day I don't complete my scope of work. He did not know what I was talking about and I told him if I get fined I was looking to him for reimbursement for damages. He told me he would not make any more caps or fulfill the order. He told me to come and get my money back, I told him he owed me for my crews labor to install and remove the 21 pieces he said no, sue me. I went to Treasure Cove and they were able to produce the complete order in 5 business days (great company). Long of the short he agreed to make the product, took my check and cashed it, did not produce and cost me over $2,000 in labor and time, and his product was substandard.
