NY Dermatologist "Expert Endorser" Settles FTC Charges That She Made False Claims in Infomercial for Purported Baldness Cure FTC News Release June 16, 2009 Patricia Wexler, MD, a New York City dermatologist, has agreed to settle Federal Trade Commission charges that, as an expert endorser, she made claims that she knew or should have known were false and misleading in a program-length commercial for Omexin -- a purported baldness cure. The proposed settlement agreement, which was announced today for public comment, would prohibit Wexler from making false or unsubstantiated claims or endorsements. The Commission alleged that an advertisement in which Dr Wexler appears -- the infomercial "Can You Beat Baldness?" -- depicts her as an expert in hair loss, and that in that role she made representations such as the following: "We have patients in both a double-blind study and using what we consider to be a very active ingredient, and what we've seen is that patients are ceasing to lose their hair very quickly within starting Omexin and then within a short time after, they start seeing new hair appear. It's not just fuzz, we're seeing actual pigmented terminal hair, which is very exciting for the patient as well as the doctor." "Omexin is the first product that I can say with enthusiasm can stop hair loss and promote growth." Through such endorsements, the FTC charged, Wexler represented that Omexin contains an ingredient that curtails hair loss and promotes new hair growth, and that its effectiveness has been scientifically proven. According to the FTC's complaint, these representations were false and misleading, and Wexler knew or should have known this was the case. The complaint alleges that Dr. Wexler lacked a reasonable basis to support representations she made in her endorsement. The proposed settlement agreement would prohibit Wexler from broadcasting or assisting in the broadcasting of the "Can You Beat Baldness?" infomercial. It would also prohibit Wexler, in connection with the sale of Omexin or any other product that contains omentum -- the purported active ingredient in Omexin -- from representing that the product contains an ingredient that can curtail or reverse hair loss or promote hair growth. Further, the proposed settlement would prohibit Wexler from representing, in connection with endorsing, advertising, promoting or selling any other product or service, that the product or service is an effective hair-loss or hair-growth remedy unless these representations are true and she has competent and reliable scientific evidence to substantiate them. Definitely, the best in the city!! I see Dr Wexler, but I was referred to the office by my friend who goes to Dr Howe. I moved to the city 6 years ago and have been dealing with acne since. I have visited every top skin care specialist, dermatologist, holistic healer, esthetician-you name it. I have spent a fortune on all of their signature products, remedies and services. I started to use Proactive again and then my friend told me about Dr Wexler's office. I spoke to the office manager and she referred me to see Dr Patricia Wexler herself. I was a little nervous at first, because she is a celebrity in her own right. She was so nice though, the consultation was thorough and all in all the experience was great. She did all the necessary blood work and then advised me to get an ultrasound. When I went back for a follow up, she gave me two prescriptions and then recomended products from her line. She also suggested I come back for a series of chemical peels until my skin is 100%. I listened and for the first time I love my skin. It has honestly never looked so great!!! What I love is that her line is fairly inexpensive and it is sold at Bath and Body works, so it is easy to buy anywhere. Also, unlike most NYC Dr offices, her staff is wonderful! Dr. Wexler is one of the best dermatologists I've ever been to, and I've been to a great deal of them!! She is experienced, kind, generous, and really takes her time with me every time I go in for a visit. I am very satisfied with my results after each session. The office is clean, easy to find, and up to date. Dr. Wexler uses great products and is always is knowledgeable on the newest state of the art technology. Her wait staff and front desk staff is always enjoyable to work with. They do their best to accommodate me even when requested at last minute. Dr. Francesca Fusco is amazing at the work she does, so careful and cautious of what her clients needs are. Went in for lip fillers and they came out beautiful and so natural thanks to her, it was my first time so I was a bit nervous, so she made sure that I was pleased before I left and didn't have any issues with the final result.
