    Horrible house sale settlement experience. At settlement (October 26th) we were told we owed part…read moreof the property taxes. A week after settlement they said the county made a mistake and we didn't owe anything and refunded the tax money (with no real explanation). Then the week before Christmas they called us and said the county made another mistake and that we owed the full second payment for the property taxes ($1800). Apparently the county had told them right after settlement, that we had a pending property tax payment, and they never bothered to question that a seller had payed taxes after settlement, which sellers rarely, if ever do. I call that incompetence. They call it an oversight.

I purchased property in Castle Rock, WA and used Chicago title to make sure everything was on the up and up. I was just recovering from cancer surgery and sold my home in Vancouver, WA to buy this property. I bought the property in Castle Rock when Chicago title insurance gave me a "clean" report. After a year, 100's of dump trucks and heavy equipment started crossing my property to access the property (approx. 80 acres) bordering my east property line every day. I paid $370k for my place to get away from noise, pollution, crime, etc while I recovered from my cancer surgery. I am a senior 67 years old. I went to the City of Castle Rock, WA and asked why they were crossing my property with all this equipment, only to learn that the city had an easement to cross through my property and had partnered with a large company to haul dirt, sand, etc from the 80 acre site east of my property. I filed a complaint with Chicago Title, asking why this easement was not listed on the "Title Insurance Policy" I purchased from them in good faith, only to be jerked around. It has been almost a year now, I have had to retain an attorney, and still no results. Chicago Title's attorney called and said they would give me a whole $2500 to settle my claim. To date I have spent close to $2000 on attorney, and a few days ago Chicago Title upped their offer to settle for $5600. This is totally ridiculous and has taken over 9 months to get that. I can not use approximately 1 acre of my property that borders a small creek, the fumes and noise from the trucks and equipment is almost unbearable at times. When my attorney relayed this information to Chicago Title's attorney, I got this reply: "First, I wanted to clarify, and further address if necessary, that the City's activities on its parcel should be addressed with the City. If Mr. Hamilton has issues with the noise, diesel fumes, dust, etc., unfortunately I am not the appropriate party to respond to those concerns". I relied on Chicago Title Insurance's report, and this is what I paid for. The title report is nothing more than a scam, and you will have NO RECOURSE, when they give you a report that has errors.
