Kendall Law Firm

Kendall Law Firm

(3 reviews)

Do not hire if you expect timely communication or careful handling of client money…read moreI hired David B. Kendall / Kendall Law Firm (Charlottesville) for a personal-injury matter. The marketing is "personal touch" and "we don't get paid unless you do." What I experienced was a high-volume shop where the client is last in line. I am not restating private case facts. I am stating my opinion of the service, and pointing to the Virginia State Bar's own public record. On December 9, 2024, the Virginia State Bar Disciplinary Board issued a Public Reprimand with Terms to David Benjamin Kendall, VSB Docket No. 23-070-129181 (agreed disposition). The Board found violations of Rule 1.4 (Communication) and Rule 1.15 (Safekeeping Property). That order is public on vsb.org. According to the Board's stipulated facts (not my invention): * A Medicaid lien on a client settlement sat unaddressed for a long time after repeated notices. Kendall told the Bar he mailed reimbursement in June 2023; the check was actually issued in May 2024, from the operating account, after the complaint. * Client Deva Millward asked for a replacement settlement check after misplacing the original. The office knew for weeks. The replacement went out after the bar complaint arrived. * A workers'-compensation carrier was underpaid $1,514.90. The carrier was reimbursed from Kendall's own funds after the complaint. * Returned/voided client checks sat in a "miscellaneous" folder. One $80 item sat about two years. Another returned insurance check ($347.32) was not paid to the client until after the complaint. * MedPay reimbursement checks were left in a manila envelope until they expired. Clients were not notified when MedPay arrived. Kendall admitted deposits were late because it was "additional work." * Trust-account records were not kept as required: no proper client ledgers for a period, no receipt/disbursement journal as required, monthly reconciliations not done. He admitted he opened a new trust account because recordkeeping was inadequate. He also admitted keeping earned fees in trust as a "cushion" (personal funds in the trust account). * His own explanation, on the record: he had "135 to 160 cases all over Virginia," and the bar complaint "helped ... accelerate" work that "needed to be done." That is the official picture: delayed client money, delayed lien payments, expired MedPay, poor trust records, and communication that happens when the Bar is already involved. That pattern matches how I experienced the office: slow answers, the feeling that files sit until someone is forced to move them, and a volume practice that treats "safekeeping" and "keep the client informed" as afterthoughts. I would not trust this firm with settlement proceeds or medical-lien accounting without watching every dollar yourself. This is my opinion of the representation I received. The discipline facts above are taken from the public VSB order dated December 9, 2024. Anyone can read it.

My case was dragged out much, much longer than it should have been and it definitely hurt my prospects of getting what I deserved. The "left hand never seems to know what the right hand is doing; or in the case of constant new staff, what has been done." It seems they drag it out so they can charge more, above the percentage they take, for "services" and such. In my case they ended up with about 55% of the settlement.

The Geller Law Group

It's uncomfortable to think about awful possibilities, but the wonderful GLG team got us through it. We feel confident and secure, knowing we are thoroughly prepared for the unexpected. A recent serious illness rocked our family, but one worry we didn't have was "what if" because we have a plan. We can't recommend the firm enough!

A difficult & abused feeling experience with this firm…read more I needed legal help to process the estate of my deceased mother. I ended up wasting six months and about $4K, paid in fees, with no outcome with Geller Law. I was first requested to have a mandatory paid initial consultation session to go over my legal help needed. I was introduced to Julie S. during this session. After describing my specific case & needs, she informed me that Geller Law can handle my case. What followed was months of emotional stress & redundant conversations with the staff of this firm that yielded no results. It became clear to me that they didn't know how to legally handle my case. Some staff members were argumentative & appeared trying to take advantage of this emotional situation for me. There were redundant conversations that I was later billed for. I concluded that this firm is not the choice that can handle my case professionally. I terminated my work with them. The new law firm I selected to handle my case turned out to be more knowledgeable for my case. And, more compassionate with me. The process was handled smoothly & professionally to completion.
