Erik, in particular, is aces, particularly with the follow up as well as guiding you through the intricacies of government programs and paper trail requirements of the various laws, rule and regulations surrounding the process. Small wonder they're as successful as they are. They treat people right here and aren't trying to hide or obscure anything. Commit Fraud in order to close and sell loans for profit!!!!…read more We originated a loan with Academy Mortgage Corporation which was closed and funded on 4-8-22. Since closing it has been a nightmare! We discovered falsified closing documents to close; misleading not only us but the VA and underwriting We closed with the legally bound agreement, as stated in the closing disclosure, that principle and interest was set at $1,289 and our escrow at $88 per month. A total of $1,377/month. A requirement of closing and funding was that the correct homeowner's insurance policy was purchased and in effect. We purchased this policy which was sent to Academy Mortgage by our insurance company. We were not in possession of the policy until Academy Mortgage notified us it was approved and we needed to "bind" it in order to close. At no time in the process were we asked or told that we required either a different type of plan or additional hazard insurance for Wind and Hail based on our location. In fact, in several places the policy blatantly state WIND and HAIL excluded and there was an entire page dedicated to the notification of this fact. Academy Mortgage was in possession of all of this. We purposefully chose this property and Academy Mortgage based on the interest rate we locked into and the price of the property. These added up to a reasonable house payment which was within our budget. We were obtaining our mortgage through the Texas Veterans Land Board/VA and this was actually a recommended lender with local offices. My husband is a 100% disabled Veteran who is on a fixed disability income. This is what we could afford. We set a firm budget and we were sticking to it. We wouldn't have proceeded with the purchase if it had been a higher monthly payment. Academy Mortgage immediately sold our mortgage to Gateway Mortgage. We received a notification in the mail from both Academy Mortgage and Gateway Mortgage informing us of this transfer of servicer. Specifically written in the notification was that only the servicer (who we pay every month) would be changing. NOTHING IN THE TERMS OF THE LOAN WOULD CHANGE. On June 22, 2022, we received a notice from Gateway Mortgage stating we did not have the correct insurance in place and would need to add wind and hail hazard insurance or purchase another type of plan. We immediately contacted Academy Mortgage asking why this was suddenly a requirement and why they hadn't required it when we signed the mortgage contract. Closed, and were funded. They passed the responsibility on to Gateway Mortgage, They would take no accountability for their fraudulent practice. We attempted to obtain the insurance; it was next to impossible to obtain because the previous owner didn't record repairs with the county, file permits, or use an approved contractor. Those that would insure us quoted amounts over $6,000 per year. We consulted legal aid organizations and the VA who advised that this couldn't legally be enforced without a mortgage loan modification between us and either Academy Mortgage or Gateway Mortgage. During this time, we also discovered that Academy Mortgage had FALSIFIED our closing documents in several places beside the block for homeowner's insurance. This was in the form of entering our homeowner's policy as "Hazard" insurance. This was recorded on the closing documents (mortgage contract) and legally filed. We paid our mortgage payment, in full, every month, on time and it was accepted as a full payment and applied to our loan. We received a new annual escrow statement the end of October 2022 in the force place insurance policy was . This escrow statement charged us $1,034, a arrears of $600 per month and payment of $430. MAKING THE TOTAL PAYMENT over $2,400!!!!; Nearly doubling our monthly payment. We continue to pursue the legality of this, and the gross breach of contract with Academy Mortgage. They continue to take no responsibility or accountability. We have filed complaints with the FTC, CFPB, Dept of Savings and Lending, the Attorney General of TX and UT, the FDIC and the BBB. Academy Mortgage sent one response to BBB of Utah requesting the BBB not investigate our complaint, stating they were going to "handle" it through another Agency with whom we had filed a complaint. The BBB then closed the complaint stating a completely different and unrelated reason, this presents a implicit bias for Academy Mortgage and not advocating for the consumer, as the vision and mission of their agency sets forth. We contested this response and closure, answering that Academy Mortgage had not disclosed what the response would be and there was no way to know if it was acceptable as a resolution. We purported to the BBB that their closure was not ethical or honorable. We continue to pay the $1,377 mortgage payment on time and in full each month as agreed on when we signed our legally binding mortgage contract on time.
