After trial, the court's Statement of Decision completely omitted that issue -- and for weeks, I begged her to file a proper objection. She refused, despite knowing the deadline and knowing my rights would be lost without action. Instead of fulfilling her duty, she repeatedly told me to "file it myself," even though I was legally prohibited from doing so while she remained my attorney of record. Her behavior placed me in a no-win situation and compromised my ability to protect my interests in court. She finally filed a Substitution of Attorney, but only after I had exhausted every effort to get her to act. What's worse -- the night before the post-trial brief was due, she sent me a draft filled with egregious errors that, if filed, would have amounted to perjury.
