I paid her a flat fee of $25,000, plus $2,600 for consulting, to represent me through trial and post-trial judgment in a high-stakes family law case involving a critical life insurance issue. After trial, the court's Statement of Decision completely omitted that issue -- and for weeks, I begged her to file a proper objection. She refused, despite knowing the deadline and knowing my rights would be lost without action. Instead of fulfilling her duty, she repeatedly told me to "file it myself," even though I was legally prohibited from doing so while she remained my attorney of record. Her behavior placed me in a no-win situation and compromised my ability to protect my interests in court. She finally filed a Substitution of Attorney, but only after I had exhausted every effort to get her to act. What's worse -- the night before the post-trial brief was due, she sent me a draft filled with egregious errors that, if filed, would have amounted to perjury. I had personally paid for trial transcripts, which she clearly did not read or did not understand, and when I pointed out the factual errors, she became defensive and could not reformat my corrections into proper pleading paper. I have a recorded phone call where she tried, hours before the court deadline, to hurriedly correct these mistakes. This was despite the court having already given her extra time to do the job properly. The last-minute chaos caused unimaginable stress, and left me scrambling to protect myself as she backed away from her obligations. She continued to pressure me for more money, despite having been paid in full. This wasn't just bad service -- it was a breakdown of professional responsibility and a betrayal at a time when I was most vulnerable. Tamara Benefield has been disciplined by the State Bar of California, and (to my knowledge) does not carry malpractice insurance. That, combined with her conduct in my case, should be a red flag for anyone considering hiring her. I am now pursuing formal remedies. If your legal matter is important or time-sensitive, I urge you to protect yourself and look elsewhere.
