Our experience with this transaction was extremely disappointing and raises serious concerns about the handling of seller disclosures. The Seller's Disclosure indicated that there were no known pest issues. We relied on that disclosure when making our decision to move forward with the purchase. However, the day before closing, the listing agent (Tim Lugara) left a voicemail for our agent stating that there were drain flies near the French drain/sump area and that the seller had sprayed for them. Despite this knowledge, the Seller's Disclosure was never updated, amended, or re-signed by the parties before settlement. The issue was communicated by voicemail rather than through the formal disclosure process required for material information discovered before closing. Our agent did not receive or hear that voicemail until after settlement, meaning we were never properly informed of the issue before completing the purchase. If the disclosure had been properly updated, we would have physically reviewed and signed the revised disclosure and would have had the opportunity to investigate further, obtain additional inspections, renegotiate, delay closing, or decide not to move forward with the purchase. In fact, had we known the true extent of the drain fly issue and the related drainage concerns, we would not have purchased the home. After taking possession of the property, we discovered a significant drain fly infestation and incurred substantial expenses investigating and addressing the problem. Multiple professionals were required to inspect the property and identify the underlying cause. We understand that we waived our inspection contingency. However, waiving an inspection does not eliminate a seller's or listing agent's obligation to properly disclose known conditions or update a Seller's Disclosure when new information becomes known before closing. Our concern is not that a problem existed. Homes can have problems. Our concern is that an issue known before closing was not formally disclosed through an updated Seller's Disclosure, depriving us of the ability to make a fully informed decision.Based on our experience, we cannot recommend this agent or brokerage. read more
