FORMAL COMPLAINT AND REQUEST FOR INVESTIGATION
Re: Denial of Scheduled Testing Appointment, Identification Dispute, Police Involvement, and Location Ban

I am submitting this letter as a formal complaint regarding the manner in which I was treated at the Boise testing location on the date of my scheduled examination. I am requesting that this incident be reviewed by the appropriate management or corporate department and that I be provided with a written explanation of the decisions made during the incident.
I arrived at the Boise testing location at approximately 1:37 PM for my scheduled examination, which was scheduled to begin at approximately 1:45 PM. I arrived before my scheduled appointment time and proceeded to complete the required paperwork.
After completing the paperwork, the employee assisting me requested that I provide identification. At that time, I realized that I had accidentally left my wallet, including my physical identification, at home.
I immediately explained the situation to the employee. I also offered to show him clear photographs of both the front and back of my identification on my phone so that he could at least verify the information shown on the identification. I was told that photographs of my identification would not be accepted.
I did not refuse to provide identification. To the contrary, I attempted to provide the information available to me and immediately offered to correct the situation by returning home to retrieve the physical identification. I specifically explained that I was willing to drive home, obtain my physical ID, and return to the testing center.
I also reviewed the paperwork I had been provided and pointed out that, as far as I could determine, the printed materials did not clearly indicate that I was required to have my physical identification physically present with me at that particular stage of the process. I was nevertheless willing to comply with the requirement once it was explained to me.
Because my home is approximately nine miles from the testing location, I immediately left the facility, drove home, retrieved my physical identification, and returned to the testing location as quickly as reasonably possible.
Upon returning to the testing location, I presented my physical identification to the same employee. At that point, rather than allowing me to proceed with my examination, I was informed that I was now considered late and could no longer take the test.
I attempted to resolve the situation reasonably. I explained that I had originally arrived before my scheduled appointment time, that I had left only because I was attempting to obtain the identification I had been told was required, and that I had returned with the requested identification.
I further offered to accept a reasonable solution, including having time deducted from my testing period if necessary. I was willing to accept whatever reasonable procedure was available that would allow me to complete the examination. My goal throughout the entire interaction was simply to take the test for which I had already scheduled and made the effort to appear.
Despite these efforts, I was refused permission to take the examination.
I remained patient and respectful throughout the interaction and attempted to cooperate with the employee. I did not intentionally disregard any identification requirement, nor did I refuse to comply once the requirement was explained. The circumstances resulted from an accidental mistake involving my wallet, which I attempted to correct immediately.
The situation subsequently escalated when I stated that I did not want to leave the facility without taking the examination for which I had arrived on time. The employee then contacted law enforcement.
I found the decision to involve law enforcement particularly concerning given the circumstances. I had arrived approximately eight minutes before my scheduled appointment, had completed the required paperwork, had offered to show identification information on my phone, had voluntarily left the facility to retrieve my physical identification, had returned with the requested identification, and had continued attempting to find a reasonable solution.
At no point was my intention to cause a disturbance or prevent the employee from performing his duties. I was attempting to resolve what I believed was a procedural issue so that I could complete my scheduled examination.
I also requested the employee's name so that I could properly document the incident and identify the individual involved in my complaint. He refused to provide his name.
I was subsequently informed that I was banned from the Boise testing location and would not be permitted to return to that location to take a test.
I find the decision to ban me particularly troubling because I had made substantial efforts to correct the original identification issue and had returned with the physical identification that I was told was required. read more
