We relocated 1,000 miles away and followed all lease protocols, including paying for a professional cleaning service (for which we have receipts) upon surrendering the keys. We asked multiple times for a move-out procedure checklist and were never given one but instead were told that we were still responsible for the property despite moving to Arizona. Despite the home being left in good condition, Action Realty and the owner are attempting to withhold a significant portion of our security and pet deposits ($3,250 total) for items that clearly fall under "normal wear and tear" and "landlord maintenance" per Texas Property Code § 92.104. They are charging for "cobwebs and hard water stains" that accumulated while the house sat vacant for 3 months under their sole control. They are attempting to charge us for a rotted, brittle fence that was in poor condition upon our move-in. They have refused a reasonable settlement offer to resolve this amicably. It is frustrating to be told we are "responsible to maintain" a home we no longer had legal access to after being told to turn in our keys. If you are a tenant, be prepared for "bad faith" deductions. We are now forced to resolve this in Guadalupe County Justice Court to seek the statutory 3x damages. I would recommend looking elsewhere for a property management company that respects Texas tenant law and maintains properties fairly. KNOW YOUR TENANT RIGHTS!
