UPDATE IN RESPONSE TO Marc Mastriano REPLY…read more Marc's lengthy response focuses heavily on what I did after his representation ended, apparently to suggest my later actions somehow discredit my review. They don't, and important context is missing. Marc points out that I later contacted him about representation. By then I had spent an enormous amount on litigation and could not afford to hire another attorney and pay that attorney to learn years of complicated history. I was doing the substantive work myself. I needed an attorney to participate in the Special Master mediation process, and Marc already knew the case. I was not asking him to prepare the case, conduct discovery, draft documents, or take over the litigation. I essentially needed him to be present on the phone for mediation while I did the work. Despite that extremely limited request, he did not respond to either of my calls. There is also considerable irony in Marc using this contact to defend his prior representation. One reason I was still struggling with the Special Master process was the scope itself. I believed Marc had agreed to a substantially narrowed scope without my authorization, leaving important financial and MSA issues I had repeatedly raised outside the Special Master's analysis. I was trying to deal with the consequences afterward. Contacting the attorney who already knew the case because I could not afford to start over was not an endorsement of his prior work. Marc also makes a point of saying I later requested portions of my case file and that he responded quickly. Of course I requested my file. I was a former client continuing litigation. Requesting your own case materials from a former attorney is entirely normal. More importantly, I believed significant materials were missing. I was specifically looking for documents and emails concerning how the Special Master's scope had been established. I did not receive everything I was looking for. Sending some electronic documents quickly afterward does not change what happened during the representation. Marc also characterizes my review as "retaliation" connected to my reimbursement request. The history tells a different story. Months before my recent reimbursement request, I had already posted a negative review concerning my experience with Marc. He personally called me about it. During that conversation he became extremely emotional and told me, in substance, that the review could ruin his business. I felt sorry for him and removed it at that time. My dissatisfaction therefore existed long before my recent reimbursement request. I had also questioned his work repeatedly while the litigation was ongoing. What happened afterward made my opinion worse, not better. I had to continue the litigation, reconstruct what happened, search for documents, deal with the Special Master process, and spend substantial additional time and money trying to move the case forward. I felt I had been left in a procedural and financial hole that was extraordinarily difficult, and at times seemed practically impossible, to get out of. I am also troubled by Marc's decision to publicly disclose details of our communications. He begins his response by saying it would not be "ethical or appropriate" to discuss details publicly. Yet he then discusses communications with a former client, including when I contacted him, my request for my file, prior complaints, my later request for assistance, and details surrounding my reimbursement demand. I had not publicly disclosed many of those communications. Attorneys have continuing confidentiality obligations concerning former clients. I am not going to declare on Yelp that Marc violated attorney-client privilege or a particular professional rule. That determination belongs in the appropriate forum. But I question the judgment of invoking confidentiality and then publicly disclosing private former-client communications in an effort to discredit that client. Many attorneys receive negative reviews. They can disagree and explain that professional obligations prevent them from discussing details. I will not respond by publishing our private emails or turning Yelp into a public airing of my family-law case. Any concerns regarding confidentiality or professional conduct can be addressed through the appropriate channels. What I find most striking is the effort Marc has now devoted to defending himself publicly. I wish I had experienced this level of attention and responsiveness when I was his paying client. Marc's response spends considerable time trying to explain my conduct after his representation ended. It does very little to explain the position I was left dealing with afterward. When the dust settles and I could look back at the entire history and my opinion will not improve. It will became worse. I stand by my review!
